Touch ‘n Go LUXE Card - Titan Edition (Shopee Promotion)

Terms and Conditions

  1. The Touch ‘n Go LUXE Card - Titan Edition (Shopee Promotion) (“Promotion”) is open to all individuals who have purchased the Touch ‘n Go LUXE Card - Titan Edition (“TNG LUXE Card”) from Touch ‘n Go Sdn Bhd’s (“TNG”) Sales Channels (hereinafter defined).

  2. The Promotion will commence on 15th December 2023 and ends on 15th March 2024 (“Promotion Period”).

  3. The Promotion’s mechanics and rewards are as follows:

    i. Individuals who purchase a TNG LUXE Card (“Customer”) from TNG’s official sales channels as follows

    a) TNG’s official store on Shopee Mall;

    b) Touch ‘n Go eWallet Lazada eShop;

    c) TNG’s Service and Sales Centre located at Lot L2.07, Level 2, Nu Sentral Shopping Mall, 201, Jalan Tun Sambanthan, Kuala Lumpur Sentral, 50470 Kuala Lumpur; and

    d) TNG’s Service and Sales Centre located at Ground Floor, Tower 6, Avenue 5, Bangsar South, No. 8, Jalan Kerinchi, 59200 Kuala Lumpur, (collectively referred to as the “Sales Channels”);

    ii. will be eligible to receive a discount code amounting to Ringgit Malaysia Three (RM3.00) only (“Promo Code”) which can be used on the Customer’s next purchase of any product from TNG’s official store on Shopee Mall only with a minimum spend of Ringgit Malaysia Ten (RM10.00) only. The Promo Code shall be made available to the Customers through the quick response code (“QR Code”) located on the packaging of the TNG LUXE Card.

  4. The Promo Code is only limited to a total of thirty thousand (30,000) redemptions and shall be available to the Customers on a strictly first-come-first-served basis. If the Promo Code has been fully redeemed by the eligible Customers, the Promotion Period shall expire immediately. Notwithstanding the foregoing, TNG reserves the right to increase or decrease the total redemptions of Promo Codes at TNG’s sole discretion.

  5. The Promo Code is not exchangeable for cash, transferable or negotiable. TNG reserves the right to change the Promotion and/or the Promo Code at its discretion with another promotion of similar or lesser value without any prior notice.

  6. By participating in the Promotion, you (the Customer) consent and agree:

    a. To abide and be bound by the terms and conditions of the Promotion including any amendments or variations thereto as well as any decisions made by TNG;

    b. For TNG to collect, record, hold, store, use, and disclose your personal data (defined below) for purposes which are necessary or related to the Promotion;

    c. For TNG to disclose or publish your personal data such as your name, identities, and any general information that TNG sees fit, on any media, marketing, or advertising materials;

    d. Grant TNG the absolute and unrestricted right to modify, use and publish any still or moving images and written caption of the Customers for any promotional, marketing, commercial, or other related purpose, without any payment or compensation; and

    e. To abide by TNG’s Terms and Conditions (please refer to www.touchngo.com.my for details). You confirm that all personal information and data (“personal data”) submitted by you to TNG are accurate. You hereby give your consent to TNG to process and/or use any of your data and to release the same to TNG’s related and/or affiliated company, TNG’s existing, future business partners and/or strategic alliances and/or any other third party as TNG may in its absolute discretion deem necessary or expedient for the purpose of marketing and promotion of its products and services. Further and in addition thereto, you hereby confirm that no further permission nor consent from you would be necessary or required in relation thereto and that this shall constitute consent for the processing of your personal data.   7. TNG reserves the right to reject any Customer or refuse to provide any Customer with the Promo Code without assigning any reasons whatsoever and reserves the absolute right to cancel, terminate or suspend the Promotion with or without any prior notice and/or assigning any reason. For the avoidance of doubt, cancellation, termination or suspension by TNG shall not entitle you to any claim or compensation against TNG for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

  8. TNG, its subsidiaries, affiliates, associated companies and related corporations (as defined under Section 7 of the Companies Act 2016) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Promotion (in which case that liability is limited to the minimum allowable by law).

  9. The terms and conditions contained herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Promotion.

  10. TNG reserves the absolute right to vary, delete or add to any of the terms and conditions of the Promotion in this document (wholly or in part) from time to time without any prior notice to you. TNG’s decision in relation to all aspects of the Promotion is deemed final, binding and conclusive under any circumstances and no correspondence, complaint or appeal whatsoever will be entertained.

  11. These terms and conditions shall be governed by and construed or interpreted in accordance with the laws of Malaysia. Any dispute, controversy, claim or difference arising out of or in connection with these terms and conditions, or the breach, termination or invalidity thereof (“Dispute”) shall be settled, in so far as it is possible, by mutual consultation and consent. Parties hereby submit to the exclusive jurisdiction of the courts of Malaysia in respect of any Dispute.

  12. No failure or delay by TNG in exercising any right, power or privilege under these terms and conditions will operate as a waiver or an estoppel thereof, nor will any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any right, power or privilege hereunder.

  13. If any provision hereunder is held to be illegal, invalid or unenforceable under present or future laws, such provision shall be fully severable and these terms and conditions shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part hereof and the remaining provisions shall remain in full force and effect and shall not be affected by the illegal, invalid or unenforceable provision or by its severance herefrom.

  14. You shall not assign any right under these terms and conditions or transfer its obligations hereunder without the prior written consent of TNG. You hereby consent to TNG assigning or transferring its rights and obligations hereunder without notice to you and you shall do all that is reasonably necessary to give effect to such assignment or transfer.

  15. Subject to applicable laws, TNG makes no warranties, and hereby disclaims any and all warranties, express or implied concerning the Promo Code furnished under the Promotion. Without limiting the generality of the foregoing, subject to applicable laws, are provided “as is” without warranty of any kind, either express or implied and TNG hereby disclaims all such warranties, including but not limited to any implied warranties or merchantability, fitness for a particular purpose and/or non-infringement.

  16. If for any reason, the Promotion is not capable of running and/or the utilisation and enjoyment of the Promo Code is unable to run as planned by reason of computer virus, bug, system malfunction, tampering, unauthorised intervention, fraud, technical failures, fire, flood, earthquake, storm or other natural cataclysm, riot, strike, terrorist activity, civil commotion, government regulation, epidemic, pandemic or any other causes beyond the control of TNG (which shall include unforeseeable issues or delays in relation to any postal carrier or courier service utilized by TNG), TNG reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion and the Customer shall have no claim against TNG whatsoever.

  17. The Customers release TNG and agree to indemnify, defend and hold TNG, and any other persons and entities involved in the development, production and/or administration of the Promotion, harmless, from any and all liability for losses, harm, damage, injury, costs, fees, and expenses, including without limitation, property damage, personal injury (including emotional distress and/or death), arising from participating in the Promotion and/or claiming and utilizing the Promo Code, any activity relating to the Promotion or the Promo Code, and/or acceptance, receipt, possession, use or enjoyment of any Promo Code and for claims or causes of action based on personal data, defamation or invasion of privacy and merchandise delivery.

  18. Without limiting the generality of the above, TNG will not be held responsible, and the Customers shall indemnify and hold TNG harmless for any losses, harm, damage, injury, costs, fees, and expenses suffered by the Customers in the event the Customers are not able to utilize and enjoy the Promo Code due to any fault, act or omission of the Customers.

  19. The terms and conditions which are expressed so or which by their very nature are meant to survive the termination or expiry of the promotion shall so survive. Without derogation to the foregoing, this Clause 19 and Clauses 6, 8, 11, 12, 13, 17, 18 and 20 shall survive the termination or expiry of the Promotion.

  20. These terms and conditions are provided in Bahasa Malaysia and English only. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version and Bahasa Malaysia version of this terms and conditions, the English version shall prevail.

Master Terms and Conditions for the Enhanced Touch ‘n Go Card

1.0 Definitions

1.1 “ATM” is defined as automated teller machine;

1.2 “Card Transaction” means an electronic transaction generated using the Enhanced Touch ‘n Go Card at any of the Service Providers or Point-of-Sale for payment and/or Reload transactions.

1.3 “Card Value” means the equivalent monetary value in the Enhanced Touch ‘n Go Card which can be used towards the Services;

1.4 “Enhanced Touch ‘n Go Card” means the Touch ‘n Go smart card that has been enhanced with NFC technology that allows You to reload the smart card via the Touch ‘n Go eWallet and to conduct Services;

1.5 “Expired Card” means an Enhanced Touch ‘n Go Card with a period of seven (7) years having elapsed from the date that it was issued for use as set out in the Touch ‘n Go eWallet or any other period of time determined by TNGSB from time-to-time;

1.6 “Identification Document” is defined as customer NRIC or Passport, which serves as identification and verification documents.

1.7 “Invalidated” means the invalidation of an Enhanced Touch ‘n Go Card in which it cannot be utilized at any point-of-usages, e.g. toll lanes, transit, parking, retail outlets and/or other closed community areas as specified by TNGSB due to it being expired, lost, stolen or compromised due to fraud;

1.8 “Issuer” means TNGSB or any other third parties as authorized by TNGSB in Malaysia;

1.9 “NFC” means near field communication technology;

1.10 “PayDirect” means a feature that allows You to make payment at any participating Service Providers using Your Enhanced Touch ‘n Go Card or any other applicable product offering in which the charge will be deducted directly from Your Touch ‘n Go eWallet Account balance;

1.11 “Personal Data” means any information relating to an identifiable person who can be directly or indirectly identified by the information collected by the Issuer from You;

1.12 “Point-of-Sale” means a facility where the Enhanced Touch ‘n Go Card is sold or issued, Reload transaction can be performed and other customer support and services are rendered. The list of authorized Point-of-Sale are listed on the TNGSB Website at; https://www.touchngo.com.my/;

1.13 “Product Customized Card” refers to the product customized Enhanced Touch ‘n Go Cards issued by TNGSB in collaboration with its business partners from time-to-time;

1.14 Reload” means the transaction of adding monetary value to the Enhanced Touch ‘n Go Card conducted at any authorized service providers, Point-of-Sale or via Your Touch ‘n Go eWallet Account;

1.15 “Service Provider” means the merchant, seller or organization, which has agreed to accept payments through the use of the Enhanced Touch ‘n Go Card for goods and/or services sold and/or provided. The lists of authorized Service Providers are listed on the TNGSB Website at http://www.touchngo.com.my;

1.16 “Services” means the electronic payment services provided by TNGSB via the Enhanced Touch ‘n Go Card which shall include but not limited to facilitation of Card Transaction, Reload and Pointof- Sale and the goods/services offered by its business partners utilizing TNGSB services;

1.17 “Terms and Conditions” means these terms and conditions and the terms of the Services, policies and procedures as may be varied or modified from time-to-time at TNGSB's sole discretion;

.18 “TNG Digital” means TNG Digital Sdn Bhd (Registration No.: 201701042478 (1256651-M)), an associate company of TNGSB;

1.19 “TNG eWallet T&Cs” means the terms and conditions, policies and procedures, which relates to Your use of the Touch ‘n Go eWallet, as may be varied or modified from time-to-time at TNG Digital’s sole discretion. 1.20 “TNGSB” means Touch ‘n Go Sdn Bhd (Registration No.: 199601034048 (406400-X)), a company incorporated in Malaysia and having its registered address at Tower 6, Avenue 5, No. 8, Jalan Kerinchi, Bangsar South, 59200 Kuala Lumpur;

1.21 “TNGSB Portal” means TNGSB’s portal which can be found at https://tngportal.touchngo.com.my/;

1.22 “TNGSB’s e-Refund Portal” means TNGSB’s e-refund portal which can be found at https://customerservice.touchngo.com.my/erefund/;

1.23 “TNGSB Website” means TNGSB’s corporate website which can be found at http://www.touchngo.com.my;

1.24 “TT” is defined as telegraphic transfer;

1.25 “Touch ‘n Go eWallet” means an electronic wallet offered by TNG Digital that store digital money via its e-wallet application through Your smart phone in accordance with the TNG eWallet T&Cs;

1.26 “Touch ‘n Go eWallet Account” means the mobile payment account created with TNG Digital when You register for Touch ‘n Go eWallet;

1.27 “Unclaimed Monies” means monies remaining in the Enhanced Touch ‘n Go Card for a period of not less than seven (7) years from the last transaction date as defined under the prevailing Unclaimed Money Act 1965; and

1.28 “You” or “Your” means you as the person to whom the Enhanced Touch ‘n Go Card has been issued for the purpose of using the Services in accordance with these Terms and Conditions.

2.0 General Terms

2.1 Agreement

2.1.1 These Terms and Conditions will govern the Enhanced Touch ‘n Go Card including the Product Customised Card. Kindly refer to Clause 10 of these Terms and Conditions for additional terms and conditions applicable on these Product Customized Cards.

2.1.2 The Services are provided on an "as-is" and "as-available" basis and the use of the Services is at Your own risk. TNGSB specifically disclaims all warranties of any kind including but not limited to availability, accessibility and uninterrupted use of the Services.

2.1.3 TNGSB reserves the right at its absolute discretion, from time-to-time, to amend these Terms and Conditions or any part thereof.

2.1.4 TNGSB shall furnish You with the notice on the amendment to these Terms and Conditions which shall be published on TNGSB Website and/or in national daily newspapers and/or via any electronic means, as the case may be, no less than twenty-one (21) days prior to the effective date of the said amendments to the Terms and Conditions.

2.1.5 Your continued use of the Services after the effective date of the amendments to the Terms and Conditions shall constitute unconditional acceptance of such amendments by You. If You do not accept such amendments, You are entitled to terminate Your use of the Services. TNGSB shall not be liable to You for any claims, losses, damages, expenses or costs in whatsoever manner resulting therefrom.

2.2 Use of the Enhanced Touch ‘n Go Card

2.2.1 The Enhanced Touch ‘n Go Card can be used at all Touch ‘n Go point-of-usage, e.g. toll, transit, parking, retail outlets and/or other closed community areas as specified by TNGSB.

2.2.2 When an Enhanced Touch ‘n Go Card is used at the point of entry to access the Services for road tolling, the same Enhanced Touch ‘n Go Card must be used at the point of exit. If a different/alternative Enhanced Touch ‘n Go Card is utilized or RFID Tag or such other alternative card is utilized at the point of exit, the Service Provider reserves the right to impose additional charges on the RFID Tag or the different/alternative Enhanced Touch ‘n Go Card.

2.2.3 You are encouraged to register Your Enhanced Touch ‘n Go Card by performing online registration through the TNGSB Portal. Subject to You first registering Your Enhanced Touch ‘n Go Card at the TNGSB Portal, if You wish to terminate Your Enhanced Touch ‘n Go Card, You may request for a refund of the balance of Your Card Value by referring to Clause 6 below.

2.2.4 When You register Your Enhanced Touch ‘n Go Card via TNGSB Portal, You must ensure that the Personal Data provided by You is accurate, complete, not misleading and kept up-to-date as and when it changes. You may update Your Personal Data by contacting TNGSB Careline at 03-27148888.

2.2.5 You are required to use Your Enhanced Touch ‘n Go Card in accordance with the procedures, instructions and guidelines set by TNGSB from time-to-time and not to damage, manipulate, copy, reverse-engineer or tamper with the Enhanced Touch ‘n Go Card nor do any act of modification to the Enhanced Touch ‘n Go Card.

2.2.6 You shall use all precautions to prevent any event of loss, theft, cloning and/or unauthorized use of the Enhanced Touch ‘n Go Card. In the event of loss, theft, cloning and/or unauthorized use of the Enhanced Touch ‘n Go Card, it is important to immediately notify TNGSB. Unauthorized use shall include conducting Reload transactions at unauthorized service providers, Point-of-Sale or persons. You shall remain liable and shall indemnify TNGSB from all claims, losses, damages, expenses or costs in whatsoever manner resulting from such unauthorized use.

2.2.7 TNGSB and/or the Service Providers shall not honour any unauthorized use of the Enhanced Touch ‘n Go Card(s) and such Enhanced Touch ‘n Go Card shall be Invalidated by TNGSB.

2.2.8 You are entitled to use the Enhanced Touch ‘n Go Card for the Services at any of the authorized Service Providers and Point-of-Sale based on the remaining Card Value of Your Enhanced Touch ‘n Go Card.

2.2.9 TNGSB shall not be liable for any act, refusal and/or omission by any of the Service Providers to accept the Enhanced Touch ‘n Go Card nor shall TNGSB be liable for any defect or deficiency in any of the Services provided by the Service Providers.

2.2.10 Your Enhanced Touch ‘n Go Card is valid at all times unless it is Invalidated or expired pursuant to these Terms and Conditions. Your Enhanced Touch ‘n Go Card is valid for use throughout the validity period of seven (7) years as seen in Your Touch ‘n Go eWallet/TNGSB Portal/Reload receipt/the back of the Enhanced Touch ‘n Go Card or Self-Service Kiosk (SSK) machine, and thereafter the Enhanced Touch ‘n Go Card shall be deemed expired and not valid for use.

2.2.11 TNGSB shall cease or suspend the Services and/or Your Enhanced Touch ‘n Go Card, as the case may be, without prior notice and/or compensation to You if:

• You breach any of the Terms and Conditions contained herein;

• You do anything which may in the opinion of TNGSB cause damage or interruption to the Services; and/or

• it is in TNGSB's opinion that the Enhanced Touch ‘n Go Card and/or the Services are or may be used for a fraudulent, illegal or unlawful purposes including but not limited to breach of legislation, regulation and/or guidelines under the Financial Services Act 2013 and/or Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

2.2.12 In the event the Services had been ceased or suspended by TNGSB in accordance with Clause

2.2.11 above, it shall be lawful for TNGSB to retain any and all Reload monies and/or unutilised Card Value until the investigation on such Enhanced Touch ‘n Go Card is completed in accordance with applicable legislation, regulation and/or guidelines.

2.2.13 In the event Services and/or the Enhanced Touch ‘n Go Card had been ceased or suspended by TNGSB in accordance with Clause 2.2.11 and 2.2.12 above, no refund on the Card Value and no compensation shall be made to You.

2.2.14 TNGSB shall cease or suspend the Services, as the case may be, with reasonable notice prior any maintenance, upgrading and/or modification works being carried out onto the Services.

2.2.15 The maximum Card Value of an Enhanced Touch ‘n Go Card is RM1,500.00 only at any one time.

2.2.16 There are no service fees imposed in the event of no activity recorded for a certain period of time as determined by TNGSB for Enhanced Touch ‘n Go Card(s).

2.3 PayDirect Function

2.3.1 You may link up Your Enhanced Touch ‘n Go Cards to Your Touch ‘n Go eWallet to, amongst other things, keep track of Your Card Value and use the PayDirect features, subject to the terms of use as set out under the Touch ‘n Go eWallet T&Cs. Invalidated Enhanced Touch ‘n Go Card cannot be linked to PayDirect function.

2.3.2 PayDirect can be used at any participating service providers allowing You to make payment using Your Enhanced Touch ‘n Go Card and the transaction amount will be deducted from Your Touch ‘n Go eWallet Account balance. In the event Your Touch ‘n Go eWallet Account balance is insufficient, the transaction amount will then be deducted from Your Card Value.

2.3.3 Refund for transactions deducted from the Card Value shall be in accordance with these Terms and Conditions whereas refund for transactions deducted from Touch ‘n Go eWallet Account balance shall be in accordance with the Touch ‘n Go eWallet T&Cs.

2.3.4 If Your Enhanced Touch ‘n Go Card is stolen/lost, You can delink Your stolen/lost Enhanced Touch 'n Go Card immediately via the Touch 'n Go eWallet application and subsequently no transactions can be made to Your Touch ‘n Go eWallet Account by the delinked Enhanced Touch ‘n Go Card.

2.3.5 You may also request for Your PayDirect transactions history up to ninety (90) days to be sent to Your preferred e-mail address.

2.3.6 For more information on Touch ‘n Go eWallet, please refer to the TNG eWallet T&Cs at https://www.tngdigital.com.my/assets/pdf/user-terms-and-conditions.pdf.

2.4 Expired Enhanced Touch ‘n Go Card

2.4.1 If Your Enhanced Touch ‘n Go Card is an Expired Card, You will not be able to use the Enhanced Touch ‘n Go Card at any point-of-usage, e.g. toll, transit, parking, retail outlets and/or other closed community areas as specified by TNGSB.

2.4.2 You may exchange Your existing Enhanced Touch ‘n Go Card in advance within one (1) month prior to the expiry date of Your Enhanced Touch ‘n Go Card without any cost to avoid any usage disruption and inconveniences at the point-of-usage

2.4.3 You may refer to Your Touch ‘n Go eWallet, TNGSB Portal/Reload receipt/the back of the Enhanced Touch ‘n Go Card/Self-Service Kiosk (SSK) machine for information on the expiry date of Your Enhanced Touch ‘n Go Card. Any conflicting dates to the expiry date of an Enhanced Touch ‘n Go Card, the expiry date as displayed on the Touch ‘n Go eWallet shall supersede such other expiry dates as mentioned above.

2.4.4 Alternatively, You may contact TNGSB Careline at 03-2714 8888 or visit our Touch 'n Go Service and Sales Centre and Reload Counter nearest to You to check the expiry date of Your Enhanced Touch ‘n Go Card.

2.4.5 Purchase of a new Enhanced Touch ‘n Go Card by You, post expiration of Your Enhanced Touch 'n Go Card, shall be at your own cost and expenses.

2.5 Lost or Stolen Enhanced Touch ‘n Go Card

2.5.1 Subject to Clause 2.5.2 below, TNGSB will invalidate all lost or stolen Enhanced Touch ‘n Go Cards upon:

i. verbal (telephone) notification by You with TNGSB’s authorized officer, followed by

ii. notification in writing addressed to TNGSB transmitted by hand/mail/e-mail/e-Refund Portal/official TNGSB social media channel; or

iii. walk in to TNGSB Service & Sales Centre to report to TNGSB’s authorized officer.

2.5.2 You will remain liable and shall indemnify TNGSB from all Card Transactions, claims, losses, damages, expenses or costs in whatsoever manner resulting from such unauthorized use .

2.5.3 Subject to Clauses 2.5.1 and 2.5.2, TNGSB shall refund the Card Value (less any applicable fees), in the manner set out under Clause 6, upon receipt of notification in writing as specified in Clause

2.5.1(ii) above provided the information given by You is complete and accurate.

2.6 Enhanced Touch ‘n Go Card Termination

You may at any time terminate and surrender the Enhanced Touch ‘n Go Card to TNGSB and discontinue the use of the Services. TNGSB will determine the condition of the returned Enhanced Touch n’ Go Card and refund any remaining Card Value to You. You may terminate Your Enhanced Touch ‘n Go Card through the following methods:

i. by contacting the TNGSB Careline;

ii. by visiting to the TNGSB Service & Sales Centres; or

iii. by requesting for termination via the TNGSB Portal.

2.7 Enhanced Touch ‘n Go Card Warranty and Replacement

2.7.1 Card Warranty

For any Enhanced Touch ‘n Go Card purchased by You, TNGSB will guarantee the functionality of the Enhanced Touch ‘n Go Card from any faulty/malfunction for a period of thirty (30) days from the date of purchase, in which, Your Card will be replaced without any charges.

2.7.2 Card Replacement

i. Any Enhanced Touch ‘n Go Card Replacement due to faulty/malfunction to the functionality of the Enhanced Touch ‘n Go Card after thirty (30) days from the date of purchase shall be at Your own cost and expenses.

ii. Subject to Clause 2.7.1 and Clause 2.7.2 (i) above, for Enhanced Touch ‘n Go Card replacement purposes, You are required to bring the Enhanced Touch ‘n Go Card to any of TNGSB Service & Sales Centres or any of the Point-of-Sale in order to obtain a replacement Enhanced Touch ‘n Go Card.

iii. If the Card Value can be determined by TNGSB’s customer service agent, the Card Value will be transferred to the replacement Enhanced Touch ‘n Go Card. You will be charged with the price of a new card if the warranty of the faulty/malfunction card has expired.

iv. If the Card Value cannot be determined by TNGSB customer service agent, the Enhanced Touch ‘n Go Card and the Card Value will not be refunded to You. You will be charged with the price of a new Enhanced Touch ‘n Go Card if warranty of the faulty/malfunction Enhanced Touch ‘n Go Card has expired.

2.8 Unclaimed Monies

2.8.1 In the event that the last transaction carried out on Your Enhanced Touch ‘n Go Card is over seven (7) years, regardless of the expiry date of the Enhanced Touch ‘n Go Card, Your remaining Card Value shall be classified as Unclaimed Monies and shall be surrendered to the Registrar of Unclaimed Money, Jabatan Akauntan Negara Malaysia by TNGSB in accordance with the requirements of the Unclaimed Money Act 1965. Thereafter, all claims relating to the refund of the Unclaimed Monies will need to be made by You with the Registrar of Unclaimed Money.

2.9 Purchase of Enhanced Touch ‘n Go Cards

2.9.1 The authorized channels for the purchase of Enhanced Touch ‘n Go Cards are:

i. Touch ‘n Go eWallet Lazada eShop;

ii. Touch ‘n Go eWallet;

iii. Touch ‘n Go Service & Sales Centres;

iv. Touch ‘n Go Customer Service Centres by Service Providers;

v. Touch ‘n Go Reload Counters at authorized agents and merchants; and

vi. Touch ‘n Go SPOT Counters at participating Petrol Service Stations.

2.9.2 The TNG eWallet FAQ shall apply to the Enhanced Touch ‘n Go Cards purchased via the Touch ‘n Go eWallet Lazada eShop and Touch ‘n Go eWallet. 2.10 Reload Channels

2.10.1 You can Reload Your Enhanced Touch ‘n Go Card through valid Reload channels authorized by TNGSB.

2.10.2 The authorised Reload channels are:

Touch ‘n Go eWallet, provided that it is installed on an NFC enabled smartphone;

Touch ‘n Go Service & Sales Centres, TNGSB;

Touch ‘n Go Customer Service Centres by the Service Providers;

Touch ‘n Go Reload Counters at authorized agents and merchants;

Touch ‘n Go SPOT Counters at participating Petrol Service Stations;

Touch ‘n Go Self-Service Kiosk (SSK); and

ATM at participating banks.

2.10.3 Selected Reload channels by agents, merchants and bank ATMs may charge a Reload fee for each Reload transaction service.

2.10.4 If You intend to Reload Your Card Value via the Touch ‘n Go eWallet, You will be required to register Your Enhanced Touch ‘n Go Card on Your Touch ‘n Go eWallet Account and complete an e-Know-Your-Consumer (eKYC) identity verification. For clarity, You will still be able to Reload Your unregistered Enhanced Touch ‘n Go Card via other Reload channels listed under Clause

2.10.2 (ii) to (viii).

2.10.5 If the Reload to Your Enhanced Touch ‘n Go Card is carried out via the Touch ‘n Go eWallet, the Reload shall be limited to the maximum Reload limit set by You on Your Touch ‘n Go eWallet Account or Ringgit Malaysia One Thousand Five Hundred (RM1,500), whichever is the lower.

2.10.6 TNGSB reserves the right to suspend or terminate the use of the Enhanced Touch ‘n Go Card and the Services and reject any refund request made of Card Value if the Reload was carried out at unauthorized Reload channels.

2.11 Applicable Tax/Taxes

2.11.1. The prices and fees herein stated are subject to any applicable taxes imposed or to be imposed by the Government of Malaysia or any other local regulatory authorities in accordance to therelevant enacted laws in Malaysia.

3.0 Enhanced Touch ‘n Go Card Registration

3.1 TNGSB Portal

3.1.1 You may register Your Enhanced Touch ‘n Go Cards at TNGSB Portal by creating a Login ID and Password and by using a valid card serial number or manufacturing number. The card serial number can be obtained from the back of Your Enhanced Touch ‘n Go Card and manufacturing number can be obtained from any Reload receipt for that Enhanced Touch ‘n Go Card.

3.1.2 Registration is required if You wish to terminate or discontinue the use of the Enhanced Touch ‘n Go Card for any refund of the Card Value.

3.1.3 If You have reported Your Enhanced Touch ‘n Go Card as lost or stolen, TNGSB shall retrieve your information from TNGSB Portal to process the refund of the Card Value less any applicable fee or charges and terminate the Enhanced Touch ‘n Go Card.

3.1.4 If You are below the age of eighteen (18), You are responsible to obtain consent from Your parent, guardian or person who has parental responsibility over You, prior to disclosing Your personal details to TNGSB. TNGSB shall not be liable for any loss or inconvenience caused to You for failing to obtain such consent.

4.0 Fees and Charges

4.1 TNGSB may vary the fees and charges from time to time by giving You advance notice of twentyone (21) days. The relevant fees and charges will be made available in TNGSB Website and the relevant Reload fees and charges via Your Touch ‘n Go eWallet Account will be made available on the Touch ‘n GoeWallet T&Cs.

4.2 TNGSB is not liable for any other fees or charges (e.g. surcharges) imposed by third parties including, but not limited to, banks, merchants, parking operator, government or the Service Providers for the usage of the Services.

5.0 Complaint Avenues and Forms of Communication

5.1 TNGSB will announce to the public any of its products, services and operational updates in a consistent manner, as and when required, in order to create awareness to You.

5.2 TNGSB shall communicate with You through either of the following modes:

i. ordinary mail;

ii. short message service (SMS)/electronic mail;

iii. display of notices at all TNGSB Service & Sales Centres and/or Customer Services Counters;

iv. published at TNGSB Website and official social media channels (including but not limited to Facebook, Instagram, LinkedIn and Twitter); and/or

v. published in national daily newspapers in the main languages, circulated generally throughout Malaysia.

5.3 All notices, requests and/or other communications from You to TNGSB may be communicated to the following:

6.0 Refund

6.1 Refund Process

6.1.1 You may request for a refund of Your Enhanced Touch ‘n Go Card’s Card Value through the following methods:

i. contact TNGSB Careline;

ii. fill up e-Refund Form available on TNGSB Website;

iii. lodgement via Touch ‘n Go eWallet

iv. visit to TNGSB Service & Sales Centres

6.1.2 TNGSB shall process all refund requests for registered Enhanced Touch ‘n Go Cards only. You are to ensure Your Enhanced Touch ‘n Go Cards are already registered via the TNGSB Portal to enable TNGSB to process the refund request.

6.1.3 Refund will be processed only for the registered owner of the Enhanced Touch ‘n Go Card once TNGSB have received complete information and supporting documents from You less any fees and charges (if applicable) (please note that at the moment TNGSB does not charge any refund fees or charges). Refund to be made to You within thirty (30) days from the refund request is made subject to TNGSB receiving Your full information.

6.1.4 If Your Enhanced Touch ‘n Go Card is

i. reported lost, stolen or damaged; or

ii. if You wish to terminate Your Enhanced Touch ‘n Go Card, You may apply for a refund of Your remaining Card Value (being the last recorded Card Value as of the submission date of Your refund request, as verified by TNGSB), less any applicable fees. If you decide to do so via the TNGSB’s various careline channels (see Clause 5), TNGSB Service & Sales Centre or Customer Service Counter, You must present your Identification Document, for verification and identification purposes. Alternatively, You can apply for an e-refund via TNGSB’s e-Refund Portal, subject to Your Enhanced Touch ‘n Go Card first being registered via the TNGSB

Portal prior to the e-refund application.

6.1.5 Your refund status can be checked at the TNGSB Website or notified to You via e-mail or SMS.

6.1.6 The refund shall be credited to Your preferred banking account or Touch ‘n Go eWallet, provided that the necessary information and documentation for the processing of the refund has been provided by You.

6.1.7 After Your Card Value has been successfully refunded, Your Enhanced Touch ‘n Go Card will beautomatically terminated by TNGSB.

6. 2 Refund via Touch ‘n Go eWallet

6.2.1 Please download the Touch ‘n Go eWallet Application and verify your Touch ‘n Go eWallet Account to facilitate the refund, subject to Clause 6.2.2.

6.2.2 The refund request will be processed if Your personal information, including but not limited to, Your NRIC number or passport number and contact number, as registered on the TNGSB Portal matches Your personal information on Your Touch ‘n Go eWallet Account.

6.3 Refund via e-Refund Form on TNGSB Website

6.3.1 You can request for refund via e-Refund Form on TNGSB Website (https://customerservice.touchngo.com.my/erefund/).

6.3.2 Touch n’ Go’s e-Refund service is available for customers who have registered their Enhanced Touch ‘n Go Card on TNGSB Portal. Register your Enhanced Touch ‘n Go Card on TNGSB Portal, and you will be able to monitor Your transactions, view Your e-statements, update Your personal details and secure your balance in the event Your Enhanced Touch ‘n Go Card gets lost/stolen.

6.3.3 Your e-Refund payment will be credited to Your preferred account based on the following:

• Payment to third party account is not allowed.

• Refund to Touch 'n Go eWallet is only applicable for verified Touch 'n Go eWallet Accounts.

6.3.4 For lost/stolen Enhanced Touch n’ Go Card eRefund request, the amount eligible for refund will be based on the available card balance on the date of the eRefund form submission.

6.4 Refund via TNGSB Service & Sales Centre

6.4.1 At TNGSB Service & SalesCentre, refund will be processed based on available mode of payment at the point of request by You.

6.4.2 Mode of payment is defined as crediting into Your bank account and/or Touch ‘n Go eWallet Account.

6.4.3 You must present Your Identification Documents for verification and identification purposes.

6.4.4 If the refund is to be made in foreign currency, TNGSB shall refund to You via TT to Your designated bank account. All TT charges shall be borne by You. Amount refunded via TT will be upon deduction of any charges relating to mode of payment.

6.5 Refund Period

6.5.1 For refund request made via TNGSB Website, TNGSB Careline, or TNGSB Sales & Service Centres that is not within Clause 6.6 and 6.7 herein, the refund shall be credited to You within fourteen (14) days upon TNGSB receiving the refund submission request with complete informationand/or documentation from You.

6.5.2 For complex refund cases that require further investigation by TNGSB and cannot be completed within fourteen (14) days, TNGSB shall communicate the reason for such delay to You in a timely manner and complete the investigation and the claim within thirty (30) days upon TNGSB receiving the refund submission request with complete information and/or documentation from You.

6.5.3 Complete information and/or documentation refers to those as stated in Clause 6.3, Your personal information, including but not limited to, Your name and ID, that is registered with the relevant bank account must match Your personal information registered with the Enhanced Touch ‘n Go Card.

6.6 Refunds for Overcharged Transactions

6.6.1 You shall request for refund for overcharged transactions within two (2) months of its occurrence.

6.6.2 Refunds for overcharged transactions are subject to the Service Provider’s verification.

6.7 Refunds for Overcharged Transactions (PLUS Highway only)

6.7.1 Refunds for overcharged transactions occurring at highways operated by PLUS Expressways Berhad (“PLUS”), subject to PLUS verification, shall be made within thirty (30) days from the transaction date.

7.0 Indemnity and Limitation of Liabilities

7.1 Indemnity

7.1.1 You agree to indemnify TNGSB against all claims, losses, liabilities, proceedings, demands, costs and expenses (including legal fees) which may result or which TNGSB may sustain in connection with or arising from the provision of the Services to You due to (i) Your own act, omission, conduct, fault, negligence or fraud; (ii) Your breach or non-compliance with these Terms and Conditions; or (iii) breach by You of any applicable laws.

7.2 Exclusion of Liability

7.2.1 TNGSB, its Board of Directors, officers, employees, agents shall not be liable to You, or any third party authorized by or claiming through You for any loss or damage, whether direct or indirect, special or consequential, suffered by You or any person authorized by You, occasioned by:

i. the use or inability to use the Services by You or any persons authorized by You;

ii. any act/omission by TNGSB, its Board of Directors, officers and/or employees in relation to the Services;

iii. any act/omission by the Service Providers in relation to the Services, howsoever caused;

iv. any loss, distortion or corruption of data arising from the use of the Services;

v. any unlawful or unauthorized access to Your Enhanced Touch ‘n Go Card data; and/or

vi. Your failure or delay in updating TNGSB as to any changes to Your information or details pertaining to Your Enhanced Touch ‘n Go Card.

7.2.2 Notwithstanding the above, in the event TNGSB is liable to You for whatsoever reason, TNGSB’s liability shall be capped at Your remaining Card Value or the sum of RM500.00 only, whichever is lower.

7.3 Fraud and Irregularities

7.3.1 Notwithstanding anything in these Terms and Conditions, in the event there are suspected fraud or irregularities in the Card Value, TNGSB shall not recognize the Card Value and no refund shall be made to you on any suspected fraudulent transactions. TNGSB shall not be held liable or responsible in relation to any claim made by You or any third parties on the Card Value.

8.0 Privacy Notice

8.1 Personal Data

8.1.1 You are fully aware of the Personal Data collected by TNGSB from You and You hereby give Your consent to TNGSB for Your Personal Data to be used, processed, stored and/or disclosed in accordance with TNGSB's Privacy Notice which can be accessed at TNGSB's website at Privacy Notice page, in compliance with the Personal Data Protection Act 2010. Please read the TNGSB's Privacy Notice carefully as it governs our collection and use of Your Personal Data.

8.1.2 You acknowledge that photographs and filming may take place at TNGSB's event or premises. TNGSB reserves the right to use the images and videos recorded at such event or our premises with Your photographs and video for purposes of TNGSB's promotion and marketing at social media channels, TNGSB's website and print materials, without obtaining any further consent from You. If You do not wish for Your photograph and/or video to be taken at TNGSB's event or premises, please notify us during the event or at our premises and we will use reasonable endeavours to comply with Your request.

9.0 Miscellaneous

9.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Malaysia and under the exclusive jurisdiction of the court of Malaya.

9.2 In addition to the Terms and Conditions contained herein, all Card Transactions transacted using the ATM shall additionally be governed by the relevant bank’s ATM Terms and Conditions.

9.3 If any of the provisions herein contained should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

9.4 These Terms and Conditions are also available in Bahasa Malaysia. In the event of any conflict or ambiguity between the terms of the English and Bahasa Malaysia version of the Terms and Conditions, the version which You have read, understood and agreed shall prevail.

10.0 Additional Terms and Conditions Applicable for Product Customized Card TNGSB may from time-to-time issues Product Customized Cards in collaboration with its business partners. Additional terms and conditions may be applied by our business partners. Please refer to the following:

i. Touch ‘n Go Zing Card: This Card has an auto-reload function. This card is issued by the participating financial institutions. It is linked with the user's credit or debit card Account which will be debited with the auto-reload value. In addition to these Terms and Conditions, the Zing Cards are also subject to the terms and conditions imposed by the respective financial institutions.

ii. Tesco Clubcard: This card can be obtained at selected Tesco stores. Please refer to the terms and conditions applicable for Tesco Clubcard holders at the Tesco Malaysia website.

iii. Watsons Card: A 2-in-1 card that provides reward points for Watson members in addition to the benefits You are entitled to with TNGSB. Clause 2.8 shall not apply to these cards. Please refer to the terms and conditions applicable for Watsons card holders at the Watsons Malaysia website.

iv. Touch ‘n Go Photocard: Personalise card with Your own chosen photo(s) or graphic(s). The card is sold at Touch ‘n Go Service & Sales Centres. Please refer to the additional terms and conditions applicable for the photocard at https://www.touchngo.com.my/)00(/Photocard-Annexure.pdf;

v. MyKad: The Government Multi-Purpose Smart Card with Touch ‘n Go features. The card shall at all times be the exclusive property of Jabatan Pendaftaran Negara and You shall not transfer MYKad to any other person. Clause 2.8 shall not apply to MyKad.

vi. Touch 'n Go BIZSpoke Card: Formerly known as "Special Design" card provided by TNGSB. It is a custom-made card specially created for TNGSB business partners to be issued to their customers.

vii. Limited Edition Card: Enhanced Touch ‘n Go Card with limited edition designs sold only for an exclusive period. Based on Clause 2.7.2 on Card Replacement within thirty (30) days of purchase, customer may request for a replacement if the Limited Design Card is found faulty/damaged. The card will be replaced with the same limited edition design card as purchased by the customer.

viii. Touch ‘n Go Advertising Card: An Enhanced Touch ‘n Go Card which displays and bears third party advertisements. For the avoidance of doubt, the Enhanced Touch ‘n Go Card displaying and bearing such third party advertisement does not directly and/or indirectly provide or extend any benefits, discounts, membership, exclusivity, privilege, rewards or any other benefit of similar nature from TNGSB and/or the third party nor does it directly and/or indirectly imply, warrant, represent or guarantees the enjoyment of any future or potential benefits, discounts, membership, exclusivity, privilege, rewards or any other benefit of similar nature from TNGSB and/or the third party.

Terma dan Syarat Induk bagi Kad Touch ‘n Go Dipertingkat

1.0 Takrif

1.1 “ATM” ditakrifkan sebagai mesin teler automatik;

1.2 “Transaksi Kad” ertinya transaksi elektronik yang dihasilkan dengan menggunakan Kad Touch ‘n Go Dipertingkat di mana-mana Pemberi Perkhidmatan atau Tempat Jualan untuk transaksi pembayaran dan/atau Tambah Nilai;

1.3 “Nilai Kad” ertinya nilai kewangan setara dalam Kad Touch ‘n Go Dipertingkat yang boleh digunakan bagi Perkhidmatan;

1.4 “Kad Touch ‘n Go Dipertingkat” ertinya kad pintar Touch ‘n Go yang telah dipertingkat dengan teknologi NFC yang membolehkan Anda menambah nilai kad pintar itu melalui e-Dompet Touch ‘n Go dan melaksanakan Perkhidmatan;

1.5 “Kad Tamat Tempoh” ertinya Kad Touch ‘n Go Dipertingkat dengan tempoh tujuh (7) tahun yang telah berlalu dari tarikh ia dikeluarkan untuk penggunaan seperti yang dinyatakan dalam e-Dompet Touch ‘n Go, atau mana-mana tempoh masa lain yang ditentukan oleh TNGSB dari semasa ke semasa;

1.6 “Dokumen Pengenalan” ditakrifkan sebagai KP atau Pasport pelanggan, yang digunakansebagai dokumen pengenalan dan penentusahan;

1.7 "Dijadikan Tidak Sah" ertinya tindakan menjadikan Kad Touch ‘n Go Dipertingkat tidak sah agar ia tidak boleh digunakan di mana-mana tempat penggunaan, cth. laluan tol, transit, tempat letak kereta, kedai runcit dan/atau kawasan komuniti tertutup lain seperti yang ditetapkan oleh TNGSB kerana ia tamat tempoh, hilang, dicuri atau terjejas akibat penipuan;

1.8 “Pengeluar” ertinya TNGSB atau mana-mana pihak ketiga lain seperti yang dibenarkan oleh TNGSB di Malaysia;

1.9 “NFC” ertinya teknologi komunikasi medan dekat (“near field communication technology”);

1.10 “Bayar Terus” (PayDirect) ertinya ciri yang membolehkan Anda membuat bayaran di manamana Pemberi Perkhidmatan penyertaan, dengan menggunakan Kad Touch ‘n Go Dipertingkat Anda atau apa-apa tawaran produk lain yang terpakai, yang baginya caj akandipotong terus daripada baki Akaun e-Dompet Touch ‘n Go Anda;

1.11 “Data Peribadi” ertinya apa-apa maklumat yang berkaitan dengan seseorang yang dapat dikenal pasti, yang boleh dikenal pasti secara langsung atau tidak langsung oleh maklumat yang dikumpulkan oleh Pengeluar daripada Anda;

1.12 “Tempat Jualan” ertinya suatu kemudahan di tempat Kad Touch ‘n Go Dipertingkat dijual atau dikeluarkan, transaksi Tambah Nilai boleh dilaksanakan dan sokongan pelanggan serta perkhidmatan lain diberikan. Senarai Tempat Jualan yang dibenarkan adalah disenaraikan pada Laman Web TNGSB pada pautan: https://www.touchngo.com.my/;

1.13 “Kad Tersuai Produk” merujuk kepada Kad Touch ‘n Go Dipertingkat tersuai produk yang dikeluarkan oleh TNGSB secara usaha sama dengan rakan perniagaannya dari semasa ke semasa;

1.14 “Tambah Nilai” ertinya transaksi penambahan nilai kewangan dalam Kad Touch ‘n Go Dipertingkat, yang dikendalikan di mana-mana pemberi perkhidmatan yang dibenarkan, Tempat Jualan atau melalui Akaun e-Dompet Touch ‘n Go Anda;

1.15 “Pemberi Perkhidmatan” ertinya peniaga, penjual atau organisasi, yang telah bersetuju untuk menerima bayaran melalui penggunaan Kad Touch ‘n Go Dipertingkat bagi barangan dan/atau perkhidmatan yang dijual dan/atau diberikan. Senarai Pemberi Perkhidmatan yang dibenarkan adalah disenaraikan pada Laman Web TNGSB pada pautan http://www.touchngo.com.my;

1.16 “Perkhidmatan” ertinya perkhidmatan pembayaran elektronik yang diberikan oleh TNGSB melalui Kad Touch ‘n Go Dipertingkat yang hendaklah merangkumi tetapi tidak terhad kepada pemudahan Transaksi Kad, Tambah Nilai dan Tempat Jualan, dan barangan/perkhidmatan yang ditawarkan oleh rakan perniagaannya dengan menggunakan perkhidmatan TNGSB;

1.17 “Terma dan Syarat” ertinya terma dan syarat ini serta terma-terma Perkhidmatan, dasar dan prosedur seperti yang boleh diubah atau diubah suai dari semasa ke semasa mengikut budi bicara TNGSB semata-mata;

1.18 “TNG Digital” ertinya TNG Digital Sdn Bhd (No. Pendaftaran: 201701042478 (1256651-M)), sebuah syarikat sekutu TNGSB;

1.19 “T&S e-Dompet TNG” ertinya terma dan syarat, dasar serta prosedur, yang berkaitan dengan penggunaan e-Dompet Touch ‘n Go oleh Anda, seperti yang boleh diubah atau diubah suai dari semasa ke semasa mengikut budi bicara TNG Digital semata-mata. 1.20 “TNGSB” ertinya Touch ‘n Go Sdn Bhd (No. Pendaftaran: 199601034048 (406400-X)), sebuah syarikat yang diperbadankan di Malaysia dan mempunyai alamat berdaftar di

Menara 6, Avenue 5, No. 8, Jalan Kerinchi, Bangsar South, 59200 Kuala Lumpur;

1.21 "Portal TNGSB" ertinya portal TNGSB yang boleh didapati pada pautan https://tngportal.touchngo.com.my/;

1.22 “Portal e-Bayaran Balik TNGSB” ertinya portal e-bayaran balik TNGSB yang boleh didapati pada pautan https://customerservice.touchngo.com.my/erefund/;

1.23 “Laman Web TNGSB” ertinya laman web korporat TNGSB yang boleh didapati pada pautan http://www.touchngo.com.my;

1.24 “TT” ditakrifkan sebagai pemindahan bertelegraf;

1.25 “e-Dompet Touch ‘n Go” ertinya dompet elektronik yang ditawarkan oleh TNG Digital yang menyimpan wang digital melalui aplikasi e-dompetnya menerusi telefon pintar Anda mengikut T&S e-Dompet TNG;

1.26 “Akaun e-Dompet Touch ‘n Go’’ ertinya akaun pembayaran mudah alih yang diwujudkan dengan TNG Digital apabila Anda mendaftar untuk e-Dompet Touch ‘n Go;

1.27 “Wang Tak Dituntut” ertinya wang yang tertinggal dalam Kad Touch ‘n Go Dipertingkat selama tempoh tidak kurang daripada tujuh (7) tahun dari tarikh transaksi terakhir seperti yang ditakrifkan di bawah Akta Wang Tak Dituntut 1965 semasa; dan

1.28 “Anda” ertinya anda sebagai orang yang kepadanya Kad Touch ‘n Go Dipertingkat telah dikeluarkan untuk tujuan menggunakan Perkhidmatan mengikut Terma dan Syarat ini.

2.0 Terma-terma Am

2.1 Perjanjian

2.1.1 Terma dan Syarat ini akan mengawal Kad Touch ‘n Go Dipertingkat, termasuk Kad Tersuai Produk. Sila rujuk kepada Fasal 10 Terma dan Syarat ini bagi terma dan syarat tambahan yang terpakai untuk Kad Tersuai Produk ini.

2.1.2 Perkhidmatan adalah diberikan atas dasar “seperti adanya” (“as-is”) dan “seperti tersedia” (“as-available”) dan penggunaan Perkhidmatan adalah atas risiko Anda sendiri. TNGSB menafikan dengan khususnya semua waranti jenis apa pun, termasuk tetapi tidak terhad kepada ketersediaan, ketercapaian dan penggunaan Perkhidmatan tanpa gangguan.

2.1.3 TNGSB mempunyai hak mengikut budi bicara mutlaknya, dari semasa ke semasa, untuk meminda Terma dan Syarat ini atau mana-mana bahagiannya.

2.1.4 TNGSB akan memberi Anda notis mengenai pindaan Terma dan Syarat ini, yang akan diterbitkan pada Laman Web TNGSB dan/atau dalam surat khabar harian kebangsaan dan/atau melalui apa-apa cara elektronik, mengikut manamana yang berkenaan, tidak kurang daripada dua puluh satu (21) hari sebelum tarikh kuat kuasa pindaan Terma dan Syarat tersebut.

2.1.5 Penggunaan Perkhidmatan secara berterusan oleh Anda selepas tarikh kuat kuasa pindaan Terma dan Syarat ini hendaklah merupakan penerimaan tanpa syarat bagi pindaan tersebut

oleh Anda. Jika Anda tidak menerima pindaan tersebut, Anda berhak menamatkan penggunaan Perkhidmatan oleh Anda. TNGSB tidak akan bertanggungjawab kepada Anda terhadap sebarang tuntutan, kerugian, ganti rugi, perbelanjaan atau kos dengan apa jua cara sekalipun akibat daripadanya.

2.2 Penggunaan Kad Touch ‘n Go Dipertingkat

2.2.1 Kad Touch ‘n Go Dipertingkat boleh digunakan di semua tempat penggunaan Touch ‘n Go, cth. tol, transit, tempat letak kereta, kedai runcit dan/atau kawasan komuniti tertutup lain seperti yang ditetapkan oleh TNGSB.

2.2.2 Apabila Kad Touch ‘n Go Dipertingkat digunakan di tempat masuk untuk mengakses Perkhidmatan bagi tol jalan, Kad Touch ‘n Go Dipertingkat yang sama mesti digunakan di tempat keluar. Jika Kad Touch ‘n Go Dipertingkat yang berbeza/alternatif digunakan atau Tag RFID atau kad alternatif lain digunakan di tempat keluar, Pemberi Perkhidmatan mempunyai hak untuk mengenakan caj tambahan ke atas Tag RFID atau Kad Touch ‘n Go Dipertingkat yang berbeza/alternatif itu.

2.2.3 Anda digalakkan supaya mendaftarkan Kad Touch ‘n Go Dipertingkat Anda dengan melaksanakan pendaftaran secara dalam rangkaian melalui Portal TNGSB. Tertakluk pada syarat bahawa Anda mendaftarkan Kad Touch ‘n Go Dipertingkat Anda pada Portal TNGSB terlebih dahulu, Anda boleh meminta pembayaran balik baki Nilai Kad Anda dengan merujuk kepada Fasal 6 di bawah.

2.2.4 Apabila Anda mendaftarkan Kad Touch ‘n Go Dipertingkat Anda melalui Portal TNGSB, Anda mesti memastikan bahawa Data Peribadi yang Anda berikan adalah tepat, lengkap, tidak mengelirukan dan dikemaskinikan apabila ia berubah. Anda boleh mengemaskinikan Data Peribadi Anda dengan menghubungi Talian Khidmat Pelanggan (Careline) TNGSB melalui talian 03-2714 8888.

2.2.5 Anda dikehendaki supaya menggunakan Kad Touch ‘n Go Dipertingkat Anda mengikut prosedur, arahan dan garis panduan yang ditetapkan oleh TNGSB dari semasa ke semasa, dan tidak merosakkan, memanipulasikan, membuat salinan, melakukan kejuruteraan membalik (“reverse-engineer”) atau mengusik Kad Touch ‘n Go Dipertingkat itu atau melakukan apa-apa pengubahsuaian Kad Touch ‘n Go Dipertingkat itu.

2.2.6 Anda hendaklah mengambil semua langkah berjaga-jaga untuk mencegah apa-apa kejadian kehilangan, kecurian, pengklonan dan/atau penggunaan Kad Touch ‘n Go Dipertingkat tanpa kebenaran. Sekiranya berlaku apa-apa kehilangan, kecurian, pengklonan dan/atau penggunaan Kad Touch ‘n Go Dipertingkat tanpa kebenaran, adalah penting untuk memberitahu TNGSB dengan segera. Penggunaan tanpa kebenaran hendaklah merangkumi perbuatan mengendalikan transaksi Tambah Nilai di pemberi perkhidmatan, Tempat Jualan atau orang tanpa kebenaran. Anda hendaklah tetap bertanggungjawab, dan hendaklah menanggung rugi TNGSB terhadap semua tuntutan, kerugian, ganti rugi, perbelanjaan atau kos dengan apa jua cara sekalipun akibat daripada penggunaan tanpa kebenaran tersebut.

2.2.7 TNGSB dan/atau Pemberi Perkhidmatan tidak akan menghormati apa-apa penggunaan Kad Touch ‘n Go Dipertingkat tanpa kebenaran dan Kad Touch ‘n Go Dipertingkat tersebut akan Dijadikan Tidak Sah oleh TNGSB.

2.2.8 Anda berhak menggunakan Kad Touch ‘n Go Dipertingkat bagi Perkhidmatan di mana-mana Pemberi Perkhidmatan dan Tempat Jualan yang dibenarkan, berdasarkan baki Nilai Kad dalam Kad Touch ‘n Go Dipertingkat Anda.

2.2.9 TNGSB tidak akan bertanggungjawab terhadap apa-apa perbuatan, penolakan dan/atau peninggalan oleh mana-mana Pemberi Perkhidmatan untuk menerima Kad Touch ‘n Go Dipertingkat, dan TNGSB juga tidak akan bertanggungjawab terhadap apa-apa kecacatan atau kekurangan dalam mana-mana Perkhidmatan yang diberikan oleh Pemberi Perkhidmatan.

2.2.10 Kad Touch ‘n Go Dipertingkat Anda adalah sah pada setiap masa melainkan jika ia Dijadikan Tidak Sah atau telah tamat tempoh menurut Terma dan Syarat ini. Kad Touch ‘n Go Dipertingkat Anda adalah sah untuk penggunaan sepanjang tempoh kesahan selama tujuh (7) tahun seperti yang terlihat dalam e-Dompet Touch ‘n Go Anda/Portal TNGSB/resit Tambah Nilai/bahagian belakang Kad Touch ‘n Go Dipertingkat atau mesin Kios Layan Diri (“Self-Service Kiosk” atau SSK), dan selepas itu Kad Touch ‘n Go Dipertingkat tersebut hendaklah disifatkan sebagai tamat tempoh dan tidak sah untuk penggunaan.

2.2.11 TNGSB akan menghentikan atau menggantung Perkhidmatan dan/atau Kad Touch ‘n Go Dipertingkat Anda, mengikut mana-mana yang berkenaan, tanpa notis terdahulu dan/atau pampasan kepada Anda jika:

• Anda memungkiri mana-mana Terma dan Syarat yang terkandung di sini;

• Anda melakukan apa-apa jua yang mungkin, pada pendapat TNGSB, menyebabkan kerosakan atau gangguan terhadap Perkhidmatan; dan/atau

• TNGSB berpendapat bahawa Kad Touch ‘n Go Dipertingkat dan/atau Perkhidmatan digunakan atau mungkin digunakan untuk tujuan penipuan, atau tujuan yang haram atau menyalahi undang-undang, termasuk tetapi tidak terhad kepada, pelanggaran perundangan, peraturan dan/atau garis panduan di bawah Akta Perkhidmatan Kewangan 2013 dan/atau Akta Pencegahan Pengubahan Wang Haram, Pencegahan Pembiayaan Keganasan dan Hasil daripada Aktiviti Haram 2001.

2.2.12 Sekiranya Perkhidmatan telah dihentikan atau digantung oleh TNGSB mengikut Fasal 2.2.11 di atas, adalah sah di sisi undang-undang bagi TNGSB untuk menyimpan apa-apa dan semua wang Tambah Nilai dan/atau Nilai Kad yang belum digunakan sehingga siasatan mengenai Kad Touch ‘n Go Dipertingkat tersebut diselesaikan mengikut perundangan, peraturan dan/atau garis panduan yang terpakai.

2.2.13 Sekiranya Perkhidmatan dan/atau Kad Touch ‘n Go Dipertingkat telah dihentikan atau digantung oleh TNGSB mengikut Fasal 2.2.11 dan 2.2.12 di atas, tiada bayaran balik bagi Nilai Kad dan tiada pampasan akan dibayar kepada Anda.

2.2.14 TNGSB akan menghentikan atau menggantung Perkhidmatan, mengikut mana-mana yang berkenaan, dengan notis munasabah sebelum apa-apa kerja penyenggaraan, peningkatan dan/atau pengubahsuaian dijalankan terhadap Perkhidmatan.

2.2.15 Nilai Kad maksimum bagi suatu Kad Touch ‘n Go Dipertingkat ialah RM1,500.00 sahaja pada satu-satu masa.

2.2.16 Tiada fi perkhidmatan yang dikenakan sekiranya tiada aktiviti direkodkan selama sesuatu tempoh masa tertentu seperti yang ditetapkan oleh TNGSB untuk Kad Touch ‘n Go Dipertingkat.

2.3 Fungsi Bayar Terus (PayDirect)

2.3.1 Anda boleh mengaitkan Kad Touch ‘n Go Dipertingkat Anda dengan e-Dompet Touch ‘n Go Anda untuk, antara perkara lain, mengawasi Nilai Kad Anda dan menggunakan ciri-ciri Bayar Terus, tertakluk pada terma-terma penggunaan seperti yang dinyatakan di bawah T&S e- Dompet Touch ‘n Go. Kad Touch ‘n Go Dipertingkat yang Dijadikan Tidak Sah tidak boleh dikaitkan dengan fungsi Bayar Terus.

2.3.2 Bayar Terus boleh digunakan di mana-mana pemberi perkhidmatan penyertaan yang membenarkan Anda membuat bayaran dengan menggunakan Kad Touch ‘n Go Dipertingkat Anda, dan amaun transaksi akan dipotong daripada baki Akaun e-Dompet Touch ‘n Go Anda. Sekiranya baki Akaun e-Dompet Touch ‘n Go Anda tidak mencukupi, amaun transaksi akan dipotong daripada Nilai Kad Anda.

2.3.3 Bayaran balik untuk transaksi yang dipotong daripada Nilai Kad hendaklah dibuat mengikut

Terma dan Syarat ini, sedangkan bayaran balik untuk transaksi yang dipotong daripada baki

Akaun e-Dompet Touch ‘n Go hendaklah dibuat mengikut T&S e-Dompet Touch ‘n Go.

2.3.4 Jika Kad Touch ‘n Go Dipertingkat Anda dicuri/hilang, Anda boleh menghapuskan kaitan Kad Touch ‘n Go Dipertingkat Anda yang dicuri/hilang dengan segera melalui aplikasi e-Dompet Touch ‘n Go, dan kemudiannya tiada transaksi yang boleh dibuat pada Akaun e-Dompet Touch ‘n Go Anda oleh Kad Touch ‘n Go Dipertingkat yang dihapuskan kaitannya.

2.3.5 Anda juga boleh meminta supaya sejarah transaksi Bayar Terus Anda sehingga sembilan puluh (90) hari dihantar kepada alamat e-mel pilihan Anda.

2.3.6 Untuk mendapatkan maklumat lanjut mengenai e-Dompet Touch ‘n Go, sila rujuk kepada T&S e-Dompet TNG pada pautan https://www.tngdigital.com.my/assets/pdf/user-terms-andconditions.pdf.

2.4 Kad Touch ‘n Go Dipertingkat yang Tamat Tempoh

2.4.1 Jika Kad Touch ‘n Go Dipertingkat Anda merupakan Kad Tamat Tempoh, Anda tidak akan dapat menggunakan Kad Touch ‘n Go Dipertingkat itu di mana-mana tempat penggunaan, cth. tol, transit, tempat letak kereta, kedai runcit dan/atau kawasan komuniti tertutup lain seperti yang ditetapkan oleh TNGSB.

2.4.2 Anda boleh menukar Kad Touch ‘n Go Dipertingkat Anda yang sedia ada terlebih dahulu dalam tempoh satu (1) bulan sebelum tarikh tamat tempoh Kad Touch ‘n Go Dipertingkat Anda tanpa sebarang kos untuk mengelakkan apa-apa gangguan penggunaan dan kesulitan di tempat penggunaan.

2.4.3 Anda boleh merujuk kepada e-Dompet Touch ‘n Go Anda, Portal TNGSB/resit Tambah Nilai/bahagian belakang Kad Touch ‘n Go Dipertingkat/mesin Kios Layan Diri (“Self-Service Kiosk” atau SSK) untuk mendapatkan maklumat mengenai tarikh tamat tempoh Kad Touch ‘n Go Dipertingkat Anda. Jika terdapat apa-apa tarikh yang bercanggah dengan tarikh tamat tempoh Kad Touch ‘n Go Dipertingkat, tarikh tamat tempoh seperti yang dipaparkan pada e- Dompet Touch ‘n Go hendaklah menggantikan tarikh tamat tempoh lain seperti yang tersebut terdahulu.

2.4.4 Sebagai alternatif, Anda boleh menghubungi Khidmat Pelanggan (Careline) TNGSB pada talian 03-2714 8888 atau mengunjungi Pusat Perkhidmatan dan Jualan serta Kaunter Tambah Nilai Touch ‘n Go kami yang terdekat dengan Anda untuk memeriksa tarikh tamat tempoh Kad Touch ‘n Go Dipertingkat Anda.

2.4.5 Anda hendaklah menanggung kos dan perbelanjaan bagi pembelian Kad Touch ‘n Go Dipertingkat baharu oleh Anda yang berlaku selepas tamatnya tempoh Kad Touch ‘n Go Dipertingkat Anda.

2.5 Kad Touch ‘n Go Dipertingkat yang Hilang atau Dicuri

2.5.1 Tertakluk pada Fasal 2.5.2 di bawah, TNGSB akan menjadikan tidak sah semua Kad Touch ‘n Go Dipertingkat yang hilang atau dicuri apabila berlakunya:

i. pemberitahuan lisan (telefon) oleh Anda kepada pegawai dibenarkan TNGSB, diikuti oleh

ii. pemberitahuan secara bertulis yang ditujukan kepada TNGSB, dihantar melalui serahan tangan/surat/e-mel/Portal e-Bayaran Balik/saluran media sosial TNGSB yang rasmi; atau

iii. kunjungan ke Pusat Perkhidmatan & Jualan TNGSB untuk melaporkannya kepada pegawai dibenarkan TNGSB.

2.5.2 Anda akan tetap bertanggungjawab, dan hendaklah menanggung rugi TNGSB, terhadap\ semua Transaksi Kad, tuntutan, kerugian, ganti rugi, perbelanjaan atau kos dengan apa jua cara sekalipun akibat daripada penggunaan tanpa kebenaran tersebut.

2.5.3 Tertakluk pada Fasal 2.5.1 dan 2.5.2, TNGSB akan membayar balik Nilai Kad (tolak apa-apa fi yang terpakai), dengan cara yang dinyatakan di bawah Fasal 6, apabila diterimanya pemberitahuan bertulis seperti yang dinyatakan dalam Fasal 2.5.1(ii) di atas, dengan syarat bahawa maklumat yang Anda berikan adalah lengkap dan tepat.

2.6 Penamatan Kad Touch ‘n Go Dipertingkat

Anda boleh, pada bila-bila masa, menamatkan dan menyerahkan Kad Touch ‘n Go Dipertingkat kepada TNGSB dan menghentikan penggunaan Perkhidmatan. TNGSB akan menentukan keadaan Kad Touch ‘n Go Dipertingkat yang dipulangkan, dan membayar balik apa-apa baki Nilai Kad kepada Anda. Anda boleh menamatkan Kad Touch ‘n Go Dipertingkat

Anda melalui kaedah berikut:

i. dengan menghubungi Khidmat Pelanggan (Careline) TNGSB;

ii. dengan mengunjungi Pusat Perkhidmatan & Jualan TNGSB; atau

iii. dengan meminta penamatan melalui Portal TNGSB.

2.7 Waranti dan Penggantian Kad Touch ‘n Go Dipertingkat

2.7.1 Waranti Kad

Untuk mana-mana Kad Touch ‘n Go Dipertingkat yang Anda beli, TNGSB akan menjamin kefungsian Kad Touch ‘n Go Dipertingkat itu daripada apa-apa kerosakan/pincang tugas selama tempoh tiga puluh (30) hari dari tarikh pembelian, yang dalamnya Kad Anda akan diganti tanpa sebarang caj.

2.7.2 Penggantian Kad

i. Anda hendaklah menanggung kos dan perbelanjaan bagi apa-apa penggantian Kad Touch ‘n Go Dipertingkat yang disebabkan oleh kerosakan/pincang tugas dalam kefungsian Kad Touch ‘n Go Dipertingkat itu selepas tiga puluh (30) hari dari tarikh pembelian.

ii. Tertakluk pada Fasal 2.7.1 dan Fasal 2.7.2 (i) di atas, bagi tujuan penggantian Kad Touch ‘n Go Dipertingkat, Anda dikehendaki supaya membawa Kad Touch ‘n Go Dipertingkat itu ke mana-mana Pusat Perkhidmatan & Jualan TNGSB atau mana-mana Tempat Jualan untuk memperoleh Kad Touch ‘n Go Dipertingkat pengganti.

iii. Jika Nilai Kad dapat ditentukan oleh ejen khidmat pelanggan TNGSB, Nilai Kad akan dipindahkan ke Kad Touch ‘n Go Dipertingkat pengganti. Anda akan dikenakan caj harga kad baharu jika waranti bagi kad yang rosak/pincang tugas telah tamat tempoh.

iv. Jika Nilai Kad tidak dapat ditentukan oleh ejen khidmat pelanggan TNGSB, Kad Touch ‘n Go Dipertingkat itu dan Nilai Kad tidak akan dibayar balik kepada Anda. Anda akan dikenakan caj harga Kad Touch ‘n Go Dipertingkat baharu jika waranti bagi Kad Touch ‘n Go Dipertingkat yang rosak/pincang tugas telah tamat tempoh.

2.8 Wang Tak Dituntut

2.8.1 Sekiranya transaksi terakhir yang dilaksanakan pada Kad Touch ‘n Go Dipertingkat Anda adalah lebih lama daripada tujuh (7) tahun, tanpa menghiraukan tarikh tamat tempoh Kad Touch ‘n Go Dipertingkat itu, baki Nilai Kad Anda hendaklah diklasifikasikan sebagai Wang Tak Dituntut dan hendaklah diserahkan kepada Pendaftar Wang Tak Dituntut, Jabatan Akauntan Negara Malaysia oleh TNGSB mengikut kehendak-kehendak Akta Wang Tak Dituntut 1965. Selepas itu, Anda perlu membuat semua tuntutan yang berkaitan dengan pembayaran balik Wang Tak Dituntut dengan Pendaftar Wang Tak Dituntut.

2.9 Pembelian Kad Touch ‘n Go Dipertingkat

2.9.1 Saluran yang dibenarkan untuk pembelian Kad Touch ‘n Go Dipertingkat ialah:

i. e-Kedai Lazada bagi e-Dompet Touch ‘n Go;

ii. e-Dompet Touch ‘n Go;

iii. Pusat Perkhidmatan & Jualan Touch ‘n Go;

iv. Pusat Khidmat Pelanggan Touch ‘n Go oleh Pemberi Perkhidmatan;

v. Kaunter Tambah Nilai Touch ‘n Go di ejen dan peniaga yang dibenarkan; dan

vi. Kaunter Touch ‘n Go SPOT di Stesen Minyak penyertaan.

2.9.2 Soalan Lazim e-Dompet TNG hendaklah terpakai untuk Kad Touch ‘n Go Dipertingkat yang dibeli melalui e-Kedai Lazada bagi e-Dompet Touch ‘n Go, dan melalui e-Dompet Touch ‘nGo. 2.10 Saluran Tambah Nilai

2.10.1 Anda boleh membuat Tambah Nilai bagi Kad Touch ‘n Go Dipertingkat Anda melalui saluran Tambah Nilai sah yang dibenarkan oleh TNGSB.

2.10.2 Saluran Tambah Nilai yang dibenarkan ialah: e-Dompet Touch ‘n Go, dengan syarat bahawa ia dipasang pada telefon pintar boleh guna NFC; Pusat Perkhidmatan & Jualan Touch ‘n Go, TNGSB; Pusat Khidmat Pelanggan Touch ‘n Go oleh Pemberi Perkhidmatan; Kaunter Tambah Nilai Touch ‘n Go di ejen dan peniaga yang dibenarkan; Kaunter Touch ‘n Go SPOT di Stesen Minyak penyertaan; Kios Layan Diri (“Self-Service Kiosk” atau SSK); dan ATM di bank penyertaan.

2.10.3 Saluran Tambah Nilai terpilih oleh ejen, peniaga dan ATM bank mungkin mengenakan fi Tambah Nilai untuk setiap perkhidmatan transaksi Tambah Nilai.

2.10.4 Jika Anda berniat untuk membuat Tambah Nilai kepada Nilai Kad Anda melalui e-Dompet Touch ‘n Go, Anda akan dikehendaki supaya mendaftarkan Kad Touch ‘n Go Dipertingkat Anda pada Akaun e-Dompet Touch ‘n Go Anda dan menyelesaikan penentusahan identiti e- Ketahui-Pengguna-Anda (“e-Know-Your-Consumer” atau eKYC). Untuk kejelasan, Anda masih akan dapat membuat Tambah Nilai bagi Kad Touch ‘n Go Dipertingkat Anda yang tidak berdaftar, melalui saluran Tambah Nilai lain yang disenaraikan di bawah Fasal 2.10.2 (ii)

hingga (viii).

2.10.5 Jika Tambah Nilai bagi Kad Touch ‘n Go Dipertingkat Anda dijalankan melalui e-Dompet Touch ‘n Go, Tambah Nilai itu adalah terhad kepada had Tambah Nilai maksimum yang telah Anda tetapkan pada Akaun e-Dompet Touch ‘n Go Anda atau Ringgit Malaysia Satu Ribu Lima Ratus (RM1,500), mengikut mana-mana yang lebih rendah.

2.10.6 TNGSB mempunyai hak untuk menggantung atau menamatkan penggunaan Kad Touch ‘n Go Dipertingkat dan Perkhidmatan, dan menolak apa-apa permintaan pembayaran balik yang dibuat bagi Nilai Kad, jika Tambah Nilai itu telah dijalankan di saluran Tambah Nilai yang tidak dibenarkan.

2.11 Cukai yang Terpakai

2.11.1. Harga dan cukai yang dinyatakan di sini adalah tertakluk pada apa-apa cukai yang terpakai, yang dikenakan atau yang akan dikenakan oleh Kerajaan Malaysia atau mana-mana pihak berkuasa pengawalseliaan tempatan lain mengikut undang-undang tergubal yang berkaitan di Malaysia.

3.0 Pendaftaran Kad Touch ‘n Go Dipertingkat

3.1 Portal TNGSB

3.1.1 Anda boleh mendaftarkan Kad Touch ‘n Go Dipertingkat Anda pada Portal TNGSB dengan mewujudkan suatu ID Log Masuk dan Kata Laluan, dan dengan menggunakan nombor siri kad atau nombor perkilangan yang sah. Nombor siri kad boleh didapati pada bahagian belakang Kad Touch ‘n Go Dipertingkat Anda, dan nombor perkilangan boleh didapati pada mana-mana resit Tambah Nilai untuk Kad Touch ‘n Go Dipertingkat itu.

3.1.2 Pendaftaran adalah dikehendaki jika Anda ingin menamatkan atau menghentikan penggunaan Kad Touch ‘n Go Dipertingkat untuk apa-apa pembayaran balik Nilai Kad.

3.1.3 Jika Anda telah melaporkan Kad Touch ‘n Go Dipertingkat Anda sebagai hilang atau dicuri, TNGSB akan mendapatkan kembali maklumat Anda daripada Portal TNGSB untuk memproses pembayaran balik Nilai Kad, tolak apa-apa fi atau caj yang terpakai, dan menamatkan Kad Touch ‘n Go Dipertingkat itu.

3.1.4 Jika Anda berumur kurang daripada lapan belas (18) tahun, Anda bertanggungjawab untuk memperoleh persetujuan daripada ibu bapa atau penjaga Anda atau orang yang mempunyai tanggungjawab ibu bapa terhadap Anda, sebelum menzahirkan butiran peribadi Anda kepada TNGSB. TNGSB tidak bertanggungjawab terhadap apa-apa kerugian atau kesulitan yang Anda alami akibat kegagalan untuk memperoleh persetujuan tersebut.

4.0 Fi dan Caj

4.1 TNGSB boleh mengubah fi dan caj dari semasa ke semasa dengan memberi Anda notis dua puluh satu (21) hari terlebih dahulu. Fi dan caj yang berkaitan akan boleh didapati pada Laman Web TNGSB, dan fi dan caj Tambah Nilai yang berkaitan melalui Akaun e-Dompet Touch ‘n Go Anda akan boleh didapati dalam T&S e-Dompet Touch ‘n Go.

4.2 TNGSB tidak bertanggungjawab terhadap apa-apa fi atau caj lain (cth. surcaj) yang dikenakan oleh pihak ketiga termasuk, tetapi tidak terhad kepada, bank, peniaga, pengendali tempat letak kereta, pihak kerajaan atau Pemberi Perkhidmatan untuk penggunaan Perkhidmatan.

5.0 Kaedah Membuat Aduan dan Bentuk Komunikasi

5.1 TNGSB akan mengumumkan kepada orang awam apa-apa maklumat kemas kini mengenai produk, perkhidmatan dan operasinya dengan cara yang konsisten, bila-bila dikehendaki, untuk mewujudkan kesedaran kepada Anda.

5.2 TNGSB akan berkomunikasi dengan Anda melalui mana-mana mod berikut:

i. surat biasa;

ii. khidmat pesanan ringkas (SMS)/mel elektronik;

iii. paparan notis di semua Pusat Perkhidmatan & Jualan dan/atau Kaunter Khidmat Pelanggan TNGSB;

iv. diterbitkan pada Laman Web dan saluran media sosial rasmi TNGSB (termasuk tetapi tidak terhad kepada Facebook, Instagram, LinkedIn dan Twitter); dan/atau

v. diterbitkan pada surat khabar harian kebangsaan dalam bahasa-bahasa utama, diedarkan secara am di seluruh Malaysia.

5.3 Semua notis, permintaan dan/atau komunikasi lain daripada Anda kepada TNGSB bolehdisampaikan kepada yang berikut:

5.5 Ketepatan dan kesempurnaan Data Peribadi Anda bergantung pada maklumat yang telah Anda berikan. TNGSB akan menganggap bahawa maklumat yang telah Anda berikan adalah tepat, kemas kini dan lengkap melainkan jika Anda memaklumkan sebaliknya. Anda boleh mengemaskinikan Data Peribadi Anda melalui mana-mana saluran di atas atau pada Portal TNGSB.

6.0 Pembayaran Balik

6.1 Proses Pembayaran Balik

6.1.1 Anda boleh meminta pembayaran balik Nilai Kad bagi Kad Touch ‘n Go Dipertingkat Anda melalui kaedah berikut:

i. menghubungi Khidmat Pelanggan (Careline) TNGSB;

ii. mengisi Borang e-Bayaran Balik yang boleh didapati pada Laman Web TNGSB;

iii. penyerahan melalui e-Dompet Touch ‘n Go

iv. kunjungan ke Pusat Perkhidmatan & Jualan TNGSB.

6.1.2 TNGSB akan memproses semua permintaan pembayaran balik untuk Kad Touch ‘n Go Dipertingkat berdaftar sahaja. Anda perlu memastikan bahawa Kad Touch ‘n Go Dipertingkat Anda sudah pun didaftarkan melalui Portal TNGSB untuk membolehkan TNGSB memproses permintaan pembayaran balik itu.

6.1.3 Pembayaran balik hanya akan diproses untuk pemilik berdaftar Kad Touch ‘n Go Dipertingkat selepas TNGSB telah menerima maklumat lengkap dan dokumen sokongan daripada Anda, tolak apa-apa fi dan caj (jika berkenaan) (sila ambil maklum bahawa buat masa ini TNGSB tidak mengenakan sebarang fi atau caj pembayaran balik). Bayaran balik akan dibuat kepada Anda dalam tempoh tiga puluh (30) hari dari masa permintaan pembayaran balik dibuat, tertakluk pada syarat bahawa TNGSB menerima maklumat lengkap Anda.

6.1.4 Jika Kad Touch ‘n Go Dipertingkat Anda

i. dilaporkan hilang, dicuri atau rosak; atau

ii. jika Anda ingin menamatkan Kad Touch ‘n Go Dipertingkat Anda, Anda boleh memohon pembayaran balik baki Nilai Kad Anda (iaitu Nilai Kad yang terakhir direkodkan setakat tarikh penyerahan permintaan pembayaran balik Anda, seperti yang ditentusahkan oleh TNGSB), tolak apa-apa fi yang terpakai. Jika Anda memutuskan untuk berbuat demikian melalui pelbagai saluran khidmat pelanggan (careline) TNGSB (lihat Fasal

5), Pusat Perkhidmatan & Jualan atau Kaunter Khidmat Pelanggan TNGSB, Anda mesti mengemukakan Dokumen Pengenalan Anda, bagi tujuan verifikasi dan pengenalpastian. Sebagai alternatif, Anda boleh memohon suatu e-bayaran balik melalui Portal e-Bayaran Balik TNGSB, tertakluk pada syarat bahawa Kad Touch ‘n Go Dipertingkat Anda didaftarkan terlebih dahulu melalui Portal TNGSB sebelum permohonan e-bayaran balik itu.

6.1.5 Status pembayaran balik Anda boleh diperiksa pada Laman Web TNGSB atau dimaklumkan kepada Anda melalui e-mel atau SMS.

6.1.6 Bayaran balik akan dikreditkan ke akaun perbankan pilihan atau e-Dompet Touch ‘n Go Anda, dengan syarat bahawa Anda telah memberikan maklumat dan dokumentasi yang diperlukan untuk pemprosesan bayaran balik itu.

6.1.7 Selepas Nilai Kad Anda telah berjaya dibayar balik, Kad Touch ‘n Go Dipertingkat Anda akan ditamatkan secara automatik oleh TNGSB.

6. 2 Pembayaran Balik melalui e-Dompet Touch ‘n Go

6.2.1 Sila muat turun Aplikasi e-Dompet Touch ‘n Go dan tentusahkan Akaun e-Dompet Touch ‘n Go Anda untuk memudahkan pembayaran balik, tertakluk pada Fasal 6.2.2.

6.2.2 Permintaan pembayaran balik akan diproses jika maklumat peribadi Anda, termasuk tetapi tidak terhad kepada, nombor KP atau nombor pasport dan nombor perhubungan Anda, seperti yang didaftarkan pada Portal TNGSB, adalah sepadan dengan maklumat peribadi Anda pada Akaun e-Dompet Touch ‘n Go Anda.

6.3 Pembayaran Balik melalui Borang e-Bayaran Balik pada Laman Web TNGSB

6.3.1 Anda boleh meminta pembayaran balik melalui Borang e-Bayaran Balik pada Laman Web TNGSB (https://customerservice.touchngo.com.my/erefund/).

6.3.2 Perkhidmatan e-Bayaran Balik Touch ‘n Go adalah tersedia untuk pelanggan yang telah mendaftarkan Kad Touch ‘n Go Dipertingkat mereka pada Portal TNGSB. Daftarkan Kad Touch ‘n Go Dipertingkat Anda pada Portal TNGSB, dan Anda akan dapat memantau transaksi Anda, melihat e-penyata Anda, mengemaskinikan butiran peribadi Anda dan melindungi baki Anda sekiranya Kad Touch ‘n Go Dipertingkat Anda hilang/dicuri.

6.3.3 Bayaran bagi e-Bayaran Balik Anda akan dikreditkan ke akaun pilihan Anda berdasarkan perkara berikut:

Rakyat Bukan Malaysia

• Bayaran akan dibuat melalui pemindahan bertelegraf (TT) yang yurannya hendaklah ditanggung oleh pelanggan.

• Nama dan nombor pasport pemegang akaun bank adalah sepadan dengan nama dan nombor pasport pemilik kad berdaftar yang didaftarkan pada portal TNGSB.

• Nama, alamat dan kod swift (jika berkenaan) bank asing adalah lengkap.

• Pembayaran ke akaun pihak ketiga tidak dibenarkan.

• Pembayaran balik ke e-Dompet Touch ‘n Go hanya terpakai untuk Akaun e-Dompet Touch ‘n Go yang telah ditentusahkan.

6.3.4 Bagi permintaan e-Bayaran Balik Kad Touch ‘n Go Dipertingkat yang hilang/dicuri, amaun yang layak dibayar balik adalah berdasarkan baki kad yang tersedia pada tarikh penyerahan borang e-Bayaran Balik.

6.4 Pembayaran Balik melalui Pusat Perkhidmatan & Jualan TNGSB

6.4.1 Di Pusat Perkhidmatan & Jualan TNGSB, bayaran balik akan diproses berdasarkan mod pembayaran yang tersedia pada masa permintaan oleh Anda.

6.4.2 Mod pembayaran ditakrifkan sebagai perkreditan ke dalam akaun bank dan/atau Akaun e- Dompet Touch ‘n Go Anda.

6.4.3 Anda mesti mengemukakan Dokumen Pengenalan Anda bagi tujuan verifikasi dan pengenalpastian.

6.4.4 Jika bayaran balik perlu dibuat dalam mata wang asing, TNGSB akan membuat bayaran balik kepada Anda melalui TT ke akaun bank tentuan Anda. Anda hendaklah menanggung semua caj TT. Amaun yang dibayar balik melalui TT adalah selepas pemotongan apa-apa caj yang berkaitan dengan mod pembayaran.

6.5 Tempoh Pembayaran Balik

6.5.1 Bagi semua permintaan pembayaran balik yang dibuat melalui Laman Web TNGSB, TNGSB Talian Khidmat Pelanggan dan Pusat Perkhidmatan & Jualan TNGSB yang tidak mengenai dalam Klausa 6.6 dan 6.7, bayaran balik akan dikreditkan kepada Anda dalam tempoh empat belas (14) hari selepas TNGSB menerima serahan pembayaran balik dengan maklumatdan/atau dokumentasi lengkap daripada Anda.

6.5.2 Bagi kes bayaran balik kompleks yang memerlukan siasatan lanjut oleh TNGSB dan tidak dapat diselesaikan dalam tempoh empat belas (14) hari, TNGSB hendaklah memaklumkan sebab kelewatan tersebut kepada Anda tepat pada masanya dan menyelesaikan siasatan dan tuntutan dalam tempoh tiga puluh (30) hari selepas TNGSB menerima permintaan penyerahan bayaran balik dengan maklumat dan/atau dokumentasi lengkap daripada Anda.

6.5.3 Maklumat lengkap merujuk kepada maklumat seperti yang dinyatakan dalam Fasal 6.3, maklumat peribadi Anda, termasuk tetapi tidak terhad kepada, nama dan ID Anda, yang didaftarkan dengan akaun bank yang berkaitan mestilah sepadan dengan maklumat peribadi Anda yang didaftarkan dengan Kad Touch ‘n Go Dipertingkat.

6.6 Pembayaran Balik untuk Transaksi yang Dikenakan Caj Berlebihan

6.6.1 Anda hendaklah meminta pembayaran balik untuk transaksi yang dikenakan caj berlebihan dalam tempoh dua (2) bulan dari masa kejadiannya.

6.6.2 Pembayaran balik untuk transaksi yang dikenakan caj berlebihan adalah tertakluk padan verifikasi Pemberi Perkhidmatan.

6.7 Pembayaran Balik untuk Transaksi yang Dikenakan Caj Berlebihan (Lebuh Raya PLUS sahaja)

6.7.1 Bayaran balik untuk transaksi yang dikenakan caj berlebihan yang berlaku di lebuh raya yang dikendalikan oleh PLUS Expressways Berhad (“PLUS”), tertakluk pada verifikasi oleh PLUS, hendaklah dibuat dalam tempoh tiga puluh (30) hari dari tarikh transaksi.

6.7.2 Anda boleh merujuk kepada Terma-terma Penggunaan PLUS pada laman web PLUS: https://www.plus.com.my/index.php?option=com_content&view=article&layout=edit&id=952&Itemid=417&lang=en dan Anda juga boleh melihat senarai lebuh raya kendalian PLUS pada laman web PLUS: https://www.plus.com.my/index.php?option=com_content&view=article&id=4&Itemid=122&lang=en.

7.0 Tanggung Rugi dan Had Liabiliti

7.1 Tanggung Rugi

7.1.1 Anda bersetuju untuk menanggung rugi TNGSB terhadap semua dakwaan, kerugian, liabiliti, prosiding, tuntutan, kos dan perbelanjaan (termasuk yuran guaman) yang mungkin diakibatkan, atau yang mungkin ditanggung oleh TNGSB, berhubung dengan atau yang timbul daripada pemberian Perkhidmatan kepada Anda yang disebabkan oleh (i) perbuatan, peninggalan, kelakuan, kesalahan, kecuaian atau penipuan oleh Anda sendiri; (ii) kemungkiran atau ketidakpatuhan Terma dan Syarat ini oleh Anda; atau (iii) pelanggaran mana-mana undang-undang yang terpakai oleh Anda.

7.2 Pengecualian Liabiliti

7.2.1 TNGSB, Lembaga Pengarah, pegawai, pekerja dan ejennya tidak akan bertanggungjawab kepada Anda atau mana-mana pihak ketiga yang dibenarkan oleh atau yang menuntut melalui Anda, terhadap apa-apa kerugian atau ganti rugi, sama ada langsung atau tidak langsung, khas atau turutan, yang Anda alami atau yang dialami oleh mana-mana orang yang Anda benarkan, yang disebabkan oleh:

i. penggunaan atau ketidakmampuan untuk menggunakan Perkhidmatan oleh Andaatau mana-mana orang yang Anda benarkan;

ii. apa-apa perbuatan/peninggalan oleh TNGSB, Lembaga Pengarah, pegawai dan/atau pekerjanya berhubung dengan Perkhidmatan;

iii. apa-apa perbuatan/peninggalan oleh Pemberi Perkhidmatan berhubung dengan Perkhidmatan, walau bagaimana jua pun disebabkan;

iv. apa-apa kehilangan, herotan atau kerosakan data yang timbul daripada penggunaan Perkhidmatan;

v. apa-apa akses kepada data Kad Touch ‘n Go Dipertingkat Anda yang menyalahi undang-undang atau yang tidak dibenarkan; dan/atau

vi. kegagalan atau kelewatan Anda untuk memberikan maklumat kemas kini kepada TNGSB mengenai apa-apa perubahan dalam maklumat atau butiran Anda berkaitan dengan Kad Touch ‘n Go Dipertingkat Anda.

7.2.2 Walau apa pun perkara di atas, sekiranya TNGSB bertanggungjawab kepada Anda atas apa jua alasan sekalipun, liabiliti TNGSB hendaklah dihadkan kepada baki Nilai Kad Anda atau jumlah sebanyak RM500.00 sahaja, mengikut mana-mana yang lebih rendah.

7.3 Penipuan dan Luar Aturan

7.3.1 Walau apa pun apa-apa jua dalam Terma dan Syarat ini, sekiranya terdapat penipuan atau luar aturan yang disyaki dalam Nilai Kad, TNGSB tidak akan mengakui Nilai Kad dan tiada bayaran balik akan dibuat kepada Anda berkenaan dengan sebarang transaksi penipuan yang disyaki. TNGSB tidak akan dipertanggungjawabkan atau bertanggungjawab berhubung dengan apa-apa tuntutan yang Anda buat atau yang dibuat oleh mana-mana pihak ketiga berkenaan dengan Nilai Kad itu.

8.0 Notis Privasi

8.1 Data Peribadi

8.1.1 Anda menyedari sepenuhnya Data Peribadi yang dikumpulkan oleh TNGSB daripada Anda, dan Anda dengan ini memberikan persetujuan Anda kepada TNGSB untuk Data Peribadi Anda digunakan, diproses, disimpan dan/atau dizahirkan mengikut Notis Privasi TNGSB yang boleh diakses pada laman web TNGSB pada laman Notis Privasi, yang mematuhi Akta Perlindungan Data Peribadi 2010. Sila baca Notis Privasi TNGSB dengan teliti kerana ia mengawal pengumpulan dan penggunaan Data Peribadi Anda oleh kami.

8.1.2 Anda mengakui bahawa pengambilan gambar dan perfileman mungkin berlaku di acara atau premis TNGSB. TNGSB mempunyai hak untuk menggunakan imej dan video yang dirakamkan di acara tersebut atau premis kami dengan gambar foto dan video Anda bagi tujuan promosi dan pemasaran oleh TNGSB pada saluran media sosial, laman web TNGSB dan bahan cetak, tanpa memperoleh apa-apa persetujuan selanjutnya daripada Anda. Jika Anda tidak ingin gambar foto dan/atau video Anda diambil di acara atau premis TNGSB, sila beritahu kami semasa acara itu atau di premis kami, dan kami akan menggunakan usaha yang munasabah untuk mematuhi permintaan Anda.

9.0 Pelbagai

9.1 Terma dan Syarat ini hendaklah dikawal dan ditafsirkan mengikut undang-undang Malaysia dan di bawah bidang kuasa eksklusif mahkamah Malaya.

9.2 Sebagai tambahan kepada Terma dan Syarat yang terkandung di sini, semua Transaksi Kad yang diurus dengan menggunakan ATM hendaklah juga dikawal oleh Terma dan Syarat ATM bank yang berkaitan.

9.3 Jika mana-mana peruntukan yang terkandung di sini menjadi tidak sah, menyalahi undangundang atau tidak boleh dikuatkuasakan di bawah mana-mana undang-undang yang terpakai, kesahan dan kebolehan penguatkuasaan peruntukan selebihnya tidak boleh dijejaskan atau dikurangkan dengan apa jua cara, dan peruntukan yang tidak sah, menyalahi undang-undang atau tidak boleh dikuatkuasakan tersebut hendaklah disifatkan sebagai dipotong.

9.4 Terma dan Syarat ini juga tersedia dalam Bahasa Inggeris. Sekiranya terdapat apa-apa percanggahan atau kesamaran antara terma-terma versi Bahasa Inggeris dan Bahasa Malaysia berkenaan Terma dan Syarat, versi Inggeris sebagai versi muktamad dan tergunapakai.

10.0 Terma dan Syarat Tambahan yang Terpakai untuk Kad Tersuai Produk

TNGSB boleh, dari semasa ke semasa, mengeluarkan Kad Tersuai Produk secara usaha sama dengan rakan perniagaannya. Terma dan syarat tambahan mungkin dipakai oleh rakan perniagaan kami. Sila rujuk kepada perkara berikut:

i. Kad Touch ‘n Go Zing: Kad ini mempunyai fungsi tambah nilai automatik. Kad ini dikeluarkan oleh institusi kewangan penyertaan. Ia dikaitkan dengan Akaun kad kredit atau debit pengguna yang akan didebitkan dengan nilai bagi tambah nilai automatik. Sebagai tambahan kepada Terma dan Syarat ini, Kad Zing juga tertakluk pada terma dan syarat yang dikenakan oleh institusi kewangan yang berkenaan.

ii. Tesco Clubcard: Kad ini boleh diperoleh di kedai Tesco terpilih. Sila rujuk kepada terma dan syarat yang terpakai untuk pemegang Tesco Clubcard pada laman web Tesco Malaysia.

iii. Kad Watsons: Kad 2-dalam-1 yang memberikan mata ganjaran untuk ahli Watson di samping manfaat yang Anda berhak menerima dengan TNGSB. Fasal 2.8 tidak terpakai untuk kad ini. Sila rujuk kepada terma dan syarat yang terpakai untuk pemegang kad Watsons pada laman web Watsons Malaysia.

iv. Kad Foto Touch ‘n Go: Peribadikan kad ini dengan gambar foto atau grafik pilihan Anda sendiri. Kad ini dijual di Pusat Perkhidmatan & Jualan Touch ‘n Go. v. MyKad: Kad Pintar Pelbagai Guna pihak Kerajaan dengan ciri-ciri Touch ‘n Go. Kad ini hendaklah, pada setiap masa, merupakan harta eksklusif Jabatan Pendaftaran Negara, dan Anda tidak boleh memindahkan MyKad kepada mana-mana orang lain. Fasal 2.8 tidak terpakai untuk MyKad.

vi. Kad Touch 'n Go BIZSpoke: Dahulunya dikenali sebagai kad “Reka Bentuk Khas” yang disediakan oleh TNGSB. Ia merupakan kad buatan tersuai yang diwujudkan khas untuk rakan perniagaan TNGSB dimana kad tersebut dikeluarkan dengan rekabentuk khas khusus kepada rakan perniagaan itu dan dijual kepada pelanggan.

vii. Kad ‘Limited Edition’ merupakan Kad Touch ‘n Go Dipertingkat dengan reka bentuk edisi terhad, yang dijual hanya selama sesuatu tempoh eksklusif. Berdasarkan Fasal

2.7.3 mengenai Penggantian kerana Tidak Sempurna/Rosak dalam tempoh tiga puluh (30) hari dari masa pembelian, pelanggan boleh meminta penggantian jika Kad Reka Bentuk Terhad didapati tidak sempurna/rosak. Kad itu akan digantikan dengan kad reka bentuk edisi terhad yang sama seperti yang dibeli oleh pelanggan.

viii. Kad Pengiklanan Touch ‘n Go: Kad Touch ‘n Go Dipertingkat yang memaparkan dan menyiarkan iklan pihak ketiga. Untuk mengelakkan keraguan, Kad Pengiklanan Touch ‘n Go tidak memberikan secara langsung dan/atau tidak langsung sebarang faedah, diskaun, keahlian, eksklusiviti, keistimewaan, ganjaran atau sebarang faedah lain yang serupa daripada TNGSB dan/atau pihak ketiga yang diiklankan. Kad Pengiklanan Touch ‘n Go tidak secara langsung dan/atau tidak langsung menggambarkan, menjamin, mewakili atau menjanjikan sebarang potensi faedah, diskaun, keahlian, eksklusiviti, keistimewaan, ganjaran atau sebarang faedah lain yang sama pada masa hadapan daripada TNGSB dan/atau pihak ketiga.
