P2P Seller Terms & Conditions

 

1.              Definitions:

 “QR Code” means a “Quick-Response” code consisting of black and white squares storing information readable either by (i) the camera of a mobile device containing the TNGD mobile wallet app; and (ii) a QR Code scanner or terminal for the purposes of facilitating the TNGD Mobile Payment Service and/or the DuitNow QR Service, as the case may be;

 “QR Code Standee” means the customized “Quick-Response” code standee offered and/or provided by TNGD to its selected user(s) of the Touch ‘n Go eWallet via the Touch ‘n Go eWallet app, and upon successful order by such user(s) through the Touch ‘n Go eWallet app.;

 “TNGD” means TNG Digital Sdn Bhd; and

  “P2P Seller” means a type of service which  shall be made available to selected user(s) by TNGD at its sole and absolute discretion. .

 2.             Delivery of QR Code Standee: The QR Code Standee shall be delivered to user(s) within fourteen (14) working days, from the date of confirmation of the QR Code Standee order, by way of courier to such user(s) registered address. TNGD will not be responsible for any non-delivery of the QR Code Standee caused by inaccuracy in details provided by such user(s) during the order process or as registered with TNGD.

 3.              Non-Delivery/Lost in Transit: If user fails to receive the QR Code Standee within the fourteen (14) working days from the date of confirmation of the QR Code Standee order, such user(s) may contact the Touch ‘n Go eWallet or TNGD’s careline at 03-50223888 to report about the non-delivery of such ordered QR Code Standee.

 4.             Cancellation: TNGD reserves the right to reject or cancel any of the orders by any user(s) at its sole discretion.

 5.             Limitation of Liability: TNGD shall be not be liable to any customers’ and/or any third party  for any incidental, special, consequential or any other losses or damages of any kind as a result of the usage of the QR Code and/or QR Code Standee provided by TNGD to any user(s). It shall be the sole responsibility of the user to resolve directly with any of its any third party, any claims or complaints made by the aforesaid in respect of any purchase or payment of goods, products or services made by the way of the Touch ‘n Go eWallet and TNGD shall not in any way be involved and responsible.

 6.             Non-representation: For the avoidance of doubt, the provision of the QR Code Standee does not mean the user is a merchant of TNGD. The user shall not hold and/or represent itself as a merchant of TNGD. Furthermore, the user shall not in any way represent to any third party that TNGD is a party to the transaction in any way whatsoever between the user and any third party.

 7.              Usage of QR Code Standee: The user shall ensure that the QR Code Standee or any other similar items are not tampered with, damaged, modified or changed in any way whatsoever. The user shall further be solely responsible to ensure the QR Code standee or any other similar items are kept safe and well taken care. The user undertakes not to share the QR Code standee with any other businesses without the prior consent of TNGD in writing. TNGD shall not be liable in anyway whatsoever for any losses or damages that may arise or suffered by the user due to the failure of the Merchant to comply with the terms of this clause. Notwithstanding anything to the foregoing, the user further undertakes to duly and diligently comply with any and all guideline(s), training(s), information material(s), manual(s) and any other similar documents as may be issued from time to time by TNGD.

 8.                 Intellectual Property: The User acknowledges and agrees that notwithstanding the provision of the QR Code Standee, TNGD does not grant any license or authorisation to the user to use TNGD’s intellectual property in any way whatsoever except to display the untampered QR Code Standee.

 9.                  Unauthorised and/or Fraudulent Transaction(s): In no event shall TNGD be liable or responsible for any unauthorised or fraudulent transactions made by the user, and/or any third party (unless the same shall be due to a fault in the TNGD Mobile Payment Service). The user shall be solely responsible and shall indemnify and/or reimburse any third party for any refunds required thereto (if applicable and whenever necessary). Any dispute transaction derived as a result from the usage of the Touch ‘n Go eWallet’s QR Code and/or the QR Code Standee provided by TNGD shall at all times be between the user and  any third party.  For the avoidance of doubt, in no event shall TNGD be a party in any resulting dispute over any aspect thereof, including, but not limited to, issues relating to merchantability, fitness for use, quality, quantity, or delivery.

 10.               Variation: TNGD reserves the right to amend these Terms and Conditions at its sole discretion from time to time as it deems fit without prior notice.

 11.               Governing Law: This Terms and Conditions is governed by the laws of Malaysia.
