Terms and Conditions

  1. The Malaysia Autoshow 2023 RFID Contest (“Campaign”) is open to all Malaysian citizens (i) with a valid National Registration Identity Card (“NRIC”), and (ii) whose residential address is located in Malaysia, and (iii) who are new or existing users of Radio Frequency Identification sticker issued by Touch ‘n Go Sdn Bhd (“TNG RFID”).

  2. The Campaign will commence on 4thMay 2023 and ends on 7th May 2023 (“Campaign Period”) at the Malaysia Autoshow 2023 held at the Malaysia Agro Exposition Park Serdang (MAEPS), 43400 Serdang, Selangor, Malaysia (“Campaign Venue”). For clarity, the Campaign is only applicable and available to TNG RFID purchased at the Campaign Venue during the Campaign Period for Class 1 private vehicles owned by Malaysian citizens only, and does not apply to TNG RFID purchased and activated at any other place for any and all corporate or commercial vehicles, including private vehicles owned by companies.

Specific Terms and Conditions on the Selection of Winners of the Campaign

  1. The Campaign’s mechanics are as follows:

    a. Customers who purchase a TNG RFID during the Campaign Period at the Campaign Venue;

    b. are one of the twenty-three (23) customers who are selected based on the Formula 1 (defined below) (“Selected Participants”); and

    c. successfully answer the simple qualifying question accurately in accordance with Clause 10 below (individuals completing items (a), (b), and (c) are referred to as the “Winners”), will be eligible to receive one of the following prizes, which shall be determined based on the Formula 2:

Grand Prize -  One (1) Trapo Hex II 5-Seater (front and rear), Nano Pro Interior Coating (6 month protection package)  and a Touch ‘n Go eWallet (“TNG eWallet”) Reload PIN worth Ringgit Malaysia One Thousand (RM 1,000.00);

2nd Prize - One (1) Trapo Classic Mark III 5-Seater (front and rear), three (3) units of Antibac Car Spray and a TNG eWallet Reload PIN worth Ringgit Malaysia Seven Hundred (RM700.00);

3rd Prize – One (1) Trapo Eco II 5-Seater, one (1) unit of Antibac Car Spray and a TNG eWallet Reload PIN worth Ringgit Malaysia Four Hundred (RM400.00); and

Consolation Prize (20 Winners) – TNG eWallet Reload PIN worth Ringgit Malaysia Fifty (RM50.00).

(each referred to as a “Reward” and collectively referred to as the “Rewards”)

For clarification, Campaign participants are eligible to only one (1) Reward per participant.

  1. The formula to determine the Selected Participants are as follows (“Formula”):

Total number of TNG RFID sold within the Campaign Period divided by 23. Every customer transaction that falls on 23rd quotient of the total number of TNG RFID sold will be selected as the Selected Winners. If the number of the 23rd quotient contain decimal points, it will be rounded to the closest round number.

Example:

Total Number of TNG RFID sold and activated within the Campaign Period = 5,734

Determination of winners based on the Formula - 5,734 ÷ 23 = 249.3 (Rounded to 249)

The 23 Selected Participants based on numeric list of all 23rd quotients of 5,734 are 249, 499, 748, 997, 1,247, 1,496, 1,745, 1,994, 2,244, 2,493, 2,742, 2,992, 3,241, 3,490, 3,740, 3,989, 4,238, 4,487, 4,737, 4,986, 5,235, 5,485, and 5,734.

Therefore, the Selected Participants are the customers whose TNG RFID are the 249th, 499th, 748th, 997th, 1,247th, 1,496th, 1,745th, 1,994th, 2,244th, 2,493rd, 2,742nd, 2,992nd, 3,241st, 3,490th, 3,740th, 3,989th, 4,238th, 4,487th, 4,737th, 4,986th, 5,235th, 5,485th, and 5,734th, sold.

Formula for determining the Reward received by the Winners (“Formula 2”):

The selection of the Winners for the Consolation Prizes shall be determined based on the total number of Selected Participants (23), divided by the number of Consolation Prizes  (20) and rounded to the nearest integer.

The selection of the Winners for the Grand Prize, 2nd Prize and 3rd Prize shall be determined based on the Winners that are not selected to receive the Consolation Prizes and purchase times in ascending order.

Example:

Determination of the Winners for the Consolation Prizes based on the Formula - 23 ÷ 20 = 1.15 (Rounded to 1)

The Selected Participants to win the Consolation Prizes are based on numeric list of all 20th quotients of 23 are 1, 2, 3, 5, 6, 7, 8, 9, 10, 12, 13, 14, 15, 16, 17, 18 and 20.

Therefore, the Winners of the Consolation Prizes are the Selected Participants whose TNG RFID are the 1st (249th), 2nd (499th), 3rd (748th), 5th (1,247th), 6th (1,496th), 7th (1,745th), 8th (1,994th), 9th (2,244th), 10th (2,493rd), 12th (2,992nd), 13th (3,241st), 14th (3,490th), 15th (3,740th), 16th (3,989th), 17th (4,238th), 18th (4,487th) and 20th (5,235th), sold.

Determination of the Winners for the Grand Prize, 2nd Prize and 3rd Prize are based on the 23 Selected Participants that are not selected as Winners for the Consolation Prizes = 4th (997th), (11th) 2,742nd and (19th) 4,737th TNG RFID sold.

The Winners for the Grand Prize, 2nd Prize and 3rd Prize will be based on purchased times in ascending order. For example, the Winner who purchased the TNG RFID the earliest during the Campaign Period among the 3 Winners who are selected to be eligible to either the Grand Prize, 2nd Prize or 3rd Prize shall be awarded the Grand Prize.  

 

  1. The Winners will be determined within fourteen (14) working day after the end of the event.

  1. Winners of the Campaign will be notified via their e-mail registered in their respective TNG eWallets and via TNG’s official social media platforms.

  1. Winners are personally responsible for ensuring that their personal particulars, contact details and email address registered in their respective TNG eWallets are accurate to receive the Reward.

  1. The Selected Participants will receive an email notification from TNG’s marketing campaign team (tngmarketing@touchngo.com.my) to answer a simple qualifying question related to TNG for verification and to be qualified to receive the Reward. Following which:

    a. the Selected Participants are required to reply according to the email instruction with the verification and answer the question within one (1) working day.

    b. in the event the Selected Participant does not reply or answer the question according to the instructions or otherwise answers the qualifying question incorrectly, another Selected Participant may be selected which the subsequent person in numeric order on the list.

    c. If the Selected Participant has already won in the prior Winner selection, a replacement Winner will be selected based on the subsequent numeric order.

  2. Upon the Selected Participants successfully answering the simple qualification question in accordance with Clause 10 above, they shall receive an e-mail in accordance with Clause 8 above and shall be deemed the Winners for that respective Campaign Cycle.

  3. The Winners shall present themselves along with their NRIC at TNG’s Headquarters located at Ground Floor, Tower 6, Avenue 5, Bangsar South No. 8, Jalan Kerinchi, 59200 Kuala Lumpur (“TNG’s HQ”) on a date that will be determined by TNG.

General Terms and Conditions of the Campaign

  1. TNG shall not be held responsible or liable for any misdirected or unsuccessful efforts to notify and award the participant with the Reward, should such misdirection or unsuccessful effort is attributable to the participant’s failure to accurately submit the necessary details and particulars, in the manner set out in these terms.

  2. Replacement Winners, if any, will be contacted via registered e-mail. No further replacement Winners will be selected for any Rewards that are forfeited or left unclaimed at this point.

  3. The Rewards are not exchangeable, transferable or negotiable. TNG reserves the right to change the Rewards at its discretion to another Rewards of similar or lesser value without any prior notice. All selected Winners who have been notified or contacted are deemed final.

  4. By participating in the Campaign, you (the participant) consent and agree:

    a. To abide and be bound by the terms and conditions of the Campaign including any amendments or variations thereto as well as any decisions made by TNG;

    b. For TNG to collect, record, hold, store, use, and disclose your personal data (defined below) for purposes which are necessary or related to the participation in the Campaign;

    c. For TNG to disclose or publish your personal data such as your name, identities, and any general information that TNG sees fit, on any media, marketing, or advertising materials;

    d. Grant TNG the absolute and unrestricted right to modify, use and publish any still or moving images and written caption of the participants for any promotional, marketing, commercial, or other related purpose, without any payment or compensation; and

    e. To abide by TNG’s Terms and Conditions (please refer to www.touchngo.com.my for details). The participant confirm that all personal information and data (“personal data”) submitted by the participant to TNG are accurate. The participant hereby gives his/her consent to TNG to process and/or use any of the participant’s data and to release the same to TNG’s related and/or affiliated company, TNG’s existing, future business partners and/or strategic alliances and/or any other third party as TNG may in its absolute discretion deem necessary or expedient for the purpose of marketing and promotion of its products and services. Further and in addition thereto, the participant hereby confirms that no further permission nor consent from the participant would be necessary or required in relation thereto and that this shall constitute consent for the processing of the participant’s personal data.   5. TNG reserves the right to reject any entry or disqualify any participant without assigning any reasons whatsoever and reserves the absolute right to cancel, terminate or suspend the Campaign with or without any prior notice and/or assigning any reason. For the avoidance of doubt, cancellation, termination or suspension by TNG shall not entitle you to any claim or compensation against TNG for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

  6. TNG, its subsidiaries, affiliates, associated companies and related corporations (as defined under Section 7 of the Companies Act 2016) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with the Campaign (in which case that liability is limited to the minimum allowable by law).

  7. The terms and conditions contained herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Campaign.

  8. TNG reserves the absolute right to vary, delete or add to any of the terms and conditions of the Campaign in this document (wholly or in part) from time to time without any prior notice to you. TNG’s decision in relation to all aspects of the Campaign is deemed final, binding and conclusive under any circumstances and no correspondence, complaint or appeal whatsoever will be entertained.

  9. These terms and conditions shall be governed by and construed or interpreted in accordance with the laws of Malaysia. Any dispute, controversy, claim or difference arising out of or in connection with these terms and conditions, or the breach, termination or invalidity thereof (“Dispute”) shall be settled, in so far as it is possible, by mutual consultation and consent. Parties hereby submit to the exclusive jurisdiction of the courts of Malaysia in respect of any Dispute.

  10. No failure or delay by TNG in exercising any right, power or privilege under these terms and conditions will operate as a waiver or an estoppel thereof, nor will any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any right, power or privilege hereunder.

  11. If any provision hereunder is held to be illegal, invalid or unenforceable under present or future laws, such provision shall be fully severable and these terms and conditions shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part hereof and the remaining provisions shall remain in full force and effect and shall not be affected by the illegal, invalid or unenforceable provision or by its severance herefrom.

  12. You shall not assign any right under these terms and conditions or transfer its obligations hereunder without the prior written consent of TNG. You hereby consent to TNG assigning or transferring its rights and obligations hereunder without notice to you and you shall do all that is reasonably necessary to give effect to such assignment or transfer.

  13. The terms and conditions which are expressed so or which by their very nature are meant to survive the termination or expiry of the Campaign shall so survive. Without derogation to the foregoing, this Clause 25 and Clauses 16, 17, 18, 21, 22, 23, and 26 shall survive the termination or expiry of the Campaign.

  14. These terms and conditions are prepared in Bahasa Malaysia and English only. In the event of any inconsistencies, conflict, ambiguity or contradictions between the English and Bahasa Malaysian versions of these terms and conditions, the English version shall prevail.
