Terms and Conditions of Touch ‘n Go RFID Surprise Cashback Campaign 2025 (“Terms and Conditions”)

  1. Campaign: Touch ‘n Go RFID Surprise Cashback Campaign 2025 is organised by Touch ‘n Go Sdn Bhd (“TNG”).

  2. Campaign Period: The Campaign will run from 1 April 2025 to 31 May 2025.

  3. Eligible Customers: The Campaign is open to all TNG eWallet users.

  4. Participation: Eligible Customers must purchase a new Touch ‘n Go Radio Frequency Identification Tag (“TNG RFID Tag”) through TNG eWallet within the Campaign Period to participate in this Campaign.

  5. Rewards

    1. Upon fulfilling the requirements in paragraph 4 (Participation), Eligible Customers will receive a randomised cashback of up to Ringgit Malaysia Thirty-Five (RM35) (“Reward”) Only in their TNG eWallet within three (3) working days after the Campaign ends. For the purpose of these Terms and Conditions, working days refer to Mondays to Fridays, excluding public holiday in Kuala Lumpur.

    2. Each Eligible Customers will only receive Reward once, regardless of the number of TNG RFID Tag purchased during the Campaign Period.

    3. TNG reserves the right to replace the Reward with another reward(s) of similar or lesser value and TNG shall notify Eligible Customers of such replacement.

    4. Only a maximum of 30,000 Eligible Customers will receive Reward. The Reward will be provided on a first come, first served basis. The Campaign will end immediately once the Reward has been distributed to 30,000 Eligible Customers or upon expiry of the Campaign Period, whichever is earlier.

    5. TNG shall not be liable if Eligible Customers do not receive the Reward due to their own errors, negligence and/or failure to provide accurate information.

General Terms and Conditions

  1. By participating in the Campaign, Eligible Customers agree to the following:

    1. Compliance with Terms and Conditions: Eligible Customers agree to comply with and be bound by these Terms and Conditions of the Campaign, including any amendments or variations made by TNG as well as any decisions made by TNG. Eligible Customers acknowledge and agree that the use of TNG RFID Tag, TNG eWallet and/or Reward shall be subject to their respective terms of use;

    2. Processing of Personal Data: Eligible Customers authorise and consent for TNG and TNG Digital Sdn. Bhd. (“TNGD”) to process, collect, record, hold, store, use, and disclose their personal information and data (“Personal Data”) in accordance with TNG’s Privacy Notice and TNGD Privacy Notice for purposes which are necessary and/or related to their participation in the Campaign. Eligible Customers confirm that this consent covers all for necessary processing of their Personal Data, and no further permission is required. Eligible Customers also confirm that the Personal Data provided to TNG and TNGD is complete and accurate;

    3. Disclosure of Personal Data: Eligible Customers permit TNG and TNGD to disclose and/or publish their Personal Data as well as any general information, on any media, marketing, or advertising materials as TNG and/or TNGD deemed appropriate, subject to applicable data protection laws; and

    4. Use of Images and Captions: Where applicable, Eligible Customers grant TNG and TNGD a perpetual, worldwide, irrevocable, royalty-free, and sublicensable right to use, modify, reproduce, distribute and and publish any still or moving images and written captions featuring or provided by Eligible Customers for any promotional, marketing, commercial, or other related purposes, in any media now known or developed on the future, without any further consent or compensation.

  2. Right to Reject and Cancel: TNG reserves the right to reject the participation of any Eligible Customer or refuse to provide the Reward with reasons . TNG also reserves the right to withdraw, cancel, terminate, or suspend the Campaign by providing seven (7) calendar days’ notice via Electronic Direct Mail (“eDM”) and a push notification. TNG and TNGD will not be liable for any losses or damages resulting from the withdrawal, cancellation, termination, or suspension of the Campaign.

  3. Exclusion of Liability: TNG and TNGD (including each party’s subsidiaries, affiliates, associated companies, and related corporations (as defined in Companies Act 2016)) will not be liable for any loss (including indirect, special, or consequential loss or loss of profits), expense, or damage suffered or sustained by Eligible Customers in connection with the Campaign, except for liability that cannot be legally limited or excluded.

  4. Prevailing Terms: These Terms and Conditions will prevail over any inconsistent terms, conditions, provisions, or representations in any other promotional or advertising materials for the Campaign.

  5. Right to Amend: TNG reserves the right to vary, delete, or add to any of these Terms and Conditions by providing seven (7) calendar days’ notice via eDM and a push notification. TNG’s decisions regarding the Campaign are final, binding, and conclusive, and no correspondence, complaint, or appeal will be entertained.

  6. Governing Law and Dispute Resolution: These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these Terms and Conditions will be settled by mutual consultation and consent, failing which, TNG and Eligible Customer agree to submit to the exclusive jurisdiction of the courts of Malaysia.

  7. No Waiver: No failure or delay by TNG in exercising any right, power, or privilege under these Terms and Conditions will operate as a waiver. A single or partial exercise of waiver does not preclude any other or further exercise of any right, power or privilege.

  8. Severability: If any provision is held to be illegal, invalid, or unenforceable, it will be fully severable, and the remaining provisions will remain in full force and effect.

  9. No Assignment: The rights and obligations in these Terms and Conditions are personal to TNG and Eligible Customers respectively. Eligible Customers cannot assign any rights and/or benefit under these Terms and Conditions without TNG’s prior written consent. TNG may assign its rights and/or benefits under these Terms and Conditions by providing written notice to Eligible Customers.

  10. Disclaimer of Warranties: Subject to applicable laws, TNG makes no warranties regarding the Reward and TNG RFID Tag and disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of any third-party intellectual property rights.

  11. Force Majeure: If the Campaign cannot run as planned due to reasons beyond TNG’s control (e.g., natural disasters, technical failures or fraud), TNG reserves the right to withdraw, cancel, terminate, modify, or suspend the Campaign and TNG will not be liable for any losses or damages resulting from the withdrawal, cancellation, termination, or suspension of the Campaign.

  12. Responsibility: TNG and TNGD will not be responsible for any losses, harm, damage, injury, costs, fees, and expenses suffered by Eligible Customers if they cannot utilize the Reward due to their own fault, act, or omission.

  13. Survival of Terms: Paragraphs 6a (Compliance with Terms and Conditions), 6b (Processing of Personal Data), 6c (Disclosure of Personal Data), 6d (Use of Images and Captions, 7 (Right to Reject and Cancel), 8 (Exclusion of Liability), 9 (Prevailing Terms), 11 (Governing Law and Dispute Resolution), 12 (No Waiver), 13 (Severability), 14 (No Assignment), 15 (Disclaimer of Warranties), 17 (Responsibility) and 19 (Language) shall remain in full force and effect after the termination or expiry of these Terms and Conditions.

  14. Language: These Terms and Conditions are provided in both Bahasa Malaysia and English. In case of any inconsistency, the English version shall prevail.
