TERMS AND CONDITION

1. Eligibility

a. This ‘Redeem & Win’ campaign (“Campaign”) is organised by TNG Digital Sdn. Bhd. (Company No. 201701042478 (1256651-M)) (“TNGD”).

b. This Campaign is only open to the following participant(s) who meet the following criteria:

(i) The participant shall be a registered Touch ‘n Go eWallet (“TNG eWallet”) user;

(ii) The participant must be at least 18 years old;

(iii) The participant’s TNG eWallet account is registered with and linked to a valid Malaysian mobile number; and

(iv) The participant has a valid GOrewards Loyalty Program (“GOrewards”) membership on TNG eWallet.

(hereinafter, the participant(s) who fulfil the above criteria shall be referred to as the “Eligible Participant(s)”).

c. Employees of Touch 'n Go are not eligible to participate in the Campaign.

d. By participating in this Campaign, all users agree to be bound by the Campaign’s Terms and Conditions herein.

2. Campaign Period

a. The campaign period is from 15 November 2024 to 14 December 2024 (“Campaign Period”).

3. Entry Mechanics

a. Eligible Participant(s) shall automatically receive one (1) entry into a lucky draw for every redemption made on the GOrewards Catalogue during the Campaign Period. However, the redemption of vouchers designated for lucky draw prizes or related purposes shall NOT qualify as entries into the lucky draw.

b. Each redemption made in accordance with the terms and conditions herein shall count as one (1) entry into the lucky draw.

c. There is no limit to the number of entries an Eligible Participant(s) may accumulate throughout the Campaign Period.

d. Only successful redemptions made in accordance with the terms and conditions hereinshall qualify as entries; cancelled or refunded transactions will not be considered.

4. Winner(s) Selection and Notification

a. Forty-five (45) winners will be selected using a computerised randomiser from the pool of Eligible Participant(s) who has gained entries (“Selected Winner(s)”). TNGD shall announce the Selected Winner(s) within thirty (30) days from the end of the Campaign.

b. The Selected Winner(s) will be required to contact TNGD via e-mail at loyalty@tngdigital.com.my within fourteen (14) working days from the date of TNGD’s announcement. The Selected Winner(s) are required to answer one (1) question correctly and provide proof of identification and contact details to TNGD for the purposes of prizes collection/delivery. The fulfilment of the prizes is three (3) months from thereon.

c. In the event the Selected Winner(s) fails to contact TNGD within the aforementioned fourteen (14) working days timeframe and/or answer the question correctly, the prizes will be forfeited and TNGD reserves the right to select an alternative winner.

d. It is the responsibility of the Selected Winner(s) to provide accurate and complete contact information and any additional details as may be required by TNGD for the fulfilment of prizes. TNGD shall not be responsible for any missing prizes, non-fulfilment, or deliver issues arising from the incorrect or incomplete information provided by the Selected Winner(s).

5. Prizes

a. The prizes for the lucky draw are as follows:

(hereinafter, the above prizes are individually or collectively referred to as the “Prize(s)”, where the context so requires).

e. The Prize(s) is distributed and assigned to the Selected Winner(s) using a computerised randomiser.

f. Prize(s) are non-transferable and cannot be exchanged for cash, products, credits, and/or any other replacement, whether in part or in full.

g. The Prize(s) is subject to stock availability. TNGD reserves the rights to substitute any of the Prize(s) with another item of similar value at its reasonable discretion, with prior notice, to the Selected Winner(s) which will be communicated on the TNG eWallet and/or other platforms deemed appropriate by TNGD.

h. In the event of any issues, defects and/or claims regarding the Prize(s), the Selected Winner(s) agrees to resolve such matters directly with the relevant merchant, supplier, distributor and/or manufacturer. TNGD is not the merchant, distributor, manufacturer or supplier of the Prize(s) and makes no warranty or representation as to the quality, merchantability and/or the fitness for the purposes of the Prize(s) and shall not be responsible for any issues, defects, claims arising thereof and/or any losses or damages that may be suffered by the Selected Winner(s).

6. General Terms

a. TNGD shall not be liable for any direct, indirect, special or consequential loss or damage (including but not limited to, loss of income, loss of profits, or goodwill arising from or in connection with this Campaign).

b. TNGD is not responsible or held liable for any technical issues, failures, interruptions, or other events of any kinds whatsoever that is beyond its control.

c. TNGD reserves the right to amend, delete, or vary this Campaign Terms and Conditions at its sole discretion by giving five (5) days prior notice of such amendment, deletion or variation and the user shall be bound to such changes. Such notice shall be posted on TNGD’s website or any other platforms as may be determined by TNGD.

d. TNGD shall be entitled to take any form of action against any user, Eligible Participant(s) and/or Selected Winner(s) who does not comply with any of the Terms and Conditions herein, are found or suspected to have abuse and/or tamper the Campaign, any other feature within the TNG eWallet, its processes, the operations, which includes but is not limited to, carrying out any suspicious activities, or fraudulent activities involving any act of deceit, and/or deception and/or cheating.

e. TNGD shall be entitled to withhold any benefits under the Campaign with notice to the users if the user is found to have breached TNGD’s Users terms and conditions. https://www.touchngo.com.my/assets/pdf/user-tnc.pdf .

f. TNGD’s decision shall be final. Any correspondence pertaining to the decision made by TNGD will not be entertained.

g. This Terms and Conditions shall be governed by the laws of Malaysia and any dispute arising out of or in connection with the campaign shall be referred to the exclusive jurisdiction of Malaysian Courts.

7. Privacy

a. By participating in the campaign, Eligible Participant(s) agrees and consents to allow his/her personal data being collected, processed, and used by TNGD in accordance with TNGD’s Privacy Policy.

TERMA DAN SYARAT

1. Kelayakan

a. Kempen ‘Tebus & Menang’ ini (“Kempen”) dianjurkan oleh TNG Digital Sdn. Bhd. (No. Syarikat 201701042478 (1256651-M)) (“TNGD”).

b. Kempen ini hanya terbuka kepada peserta berikut yang memenuhi kriteria berikut:

(i) Peserta mestilah pengguna eWallet Touch ‘n Go (“TNG eWallet”) yang berdaftar;

(ii) Peserta mestilah berumur sekurang-kurangnya 18 tahun;

(iii) Akaun TNG eWallet peserta didaftarkan dengan dan dihubungkan kepada nombor telefon bimbit Malaysia yang sah; dan

(iv) Peserta mempunyai keahlian Program Kesetiaan GOrewards (“GOrewards”) yang sah di TNG eWallet.

(Peserta yang memenuhi kriteria di atas selepas ini dirujuk sebagai "Peserta Layak").

c. Kakitangan Touch 'n Go tidak layak menyertai Kempen ini.

d. Dengan menyertai Kempen ini, semua pengguna bersetuju untuk terikat dengan Terma dan Syarat Kempen ini.

2. Tempoh Kempen

a. Tempoh kempen adalah dari 15 November 2024 hingga 14 Disember 2024 (“Tempoh Kempen”).

3. Syarat Penyertaan

a. Peserta Layak akan secara automatik menerima satu (1) penyertaan ke dalam cabutan bertuah untuk setiap penebusan yang dibuat pada Katalog GOrewards sepanjang Tempoh Kempen. Walau bagaimanapun, penebusan baucar yang ditetapkan untuk hadiah cabutan bertuah atau tujuan berkaitan TIDAK akan dikira sebagai penyertaan ke dalam cabutan bertuah.

b. Setiap penebusan yang dibuat mengikut terma dan syarat ini akan dikira sebagai satu (1) penyertaan ke dalam cabutan bertuah.

c. Tiada had kepada bilangan penyertaan yang boleh dikumpulkan oleh Peserta Layak sepanjang Tempoh Kempen.

d. Hanya penebusan berjaya yang dibuat mengikut terma dan syarat ini akan dikira sebagai penyertaan; transaksi yang dibatalkan atau dikembalikan tidak akan dipertimbangkan.

4. Pemilihan dan Pemberitahuan Pemenang

a. Empat puluh lima (45) pemenang akan dipilih menggunakan pengacak komputer dari kalangan Peserta Layak yang telah mengumpulkan penyertaan (“Pemenang Terpilih”). TNGD akan mengumumkan Pemenang Terpilih dalam masa tiga puluh (30) hari selepas akhir Kempen.

b. Pemenang Terpilih dikehendaki menghubungi TNGD melalui e-mel di loyalty@tngdigital.com.my dalam masa empat belas (14) hari bekerja dari tarikh pengumuman TNGD. Pemenang Terpilih dikehendaki menjawab satu (1) soalan dengan betul dan memberikan bukti pengenalan serta butiran hubungan kepada TNGD bagi tujuan pengumpulan/penghantaran hadiah. Penyerahan hadiah akan dibuat dalam masa tiga (3) bulan dari tarikh tersebut.

c. Jika Pemenang Terpilih gagal menghubungi TNGD dalam tempoh masa empat belas (14) hari bekerja sepertimana yang dinyatakan di atas dan/atau menjawab soalan dengan betul, hadiah akan dilucutkan dan TNGD berhak untuk memilih pemenang alternatif.

d. Pemenang Terpilih adalah bertanggungjawab untuk memberikan maklumat hubungan yang tepat dan lengkap serta butiran tambahan yang mungkin diperlukan oleh TNGD untuk penyerahan hadiah. TNGD tidak akan bertanggungjawab atas sebarang kehilangan hadiah, kegagalan penyerahan, atau isu penghantaran yang timbul daripada maklumat yang salah atau tidak lengkap yang diberikan oleh Pemenang Terpilih.

5. Hadiah

a. Hadiah cabutan bertuah adalah seperti berikut:

e. Hadiah diedarkan dan diagihkan kepada Pemenang Terpilih menggunakan pengacak komputer.

f. Hadiah tidak boleh dipindah milik dan tidak boleh ditukar dengan wang tunai, produk, kredit, dan/atau penggantian lain, sama ada sebahagian atau sepenuhnya.

g. Hadiah adalah tertakluk kepada ketersediaan stok. TNGD berhak untuk menggantikan Hadiah dengan item lain yang bernilai sama atas budi bicara yang munasabah dengan notis terlebih dahulu kepada Pemenang Terpilih, yang akan dikomunikasikan melalui TNG eWallet dan/atau platform lain seperti mana yang difikirkan sesuai oleh TNGD.

h. Sekiranya terdapat sebarang isu, kecacatan, dan/atau tuntutan berkaitan Hadiah, Pemenang Terpilih bersetuju untuk menyelesaikan perkara tersebut secara langsung dengan peniaga, pembekal, pengedar, dan/atau pengilang yang berkaitan. TNGD bukanlah peniaga, pengedar, pengilang, atau pembekal Hadiah dan tidak memberikan sebarang jaminan atau representasi tentang kualiti, kebolehdagangan, dan/atau kesesuaian untuk tujuan Hadiah tersebut serta tidak akan bertanggungjawab terhadap sebarang isu, kecacatan, tuntutan yang timbul daripadanya dan/atau sebarang kerugian atau kerosakan yang mungkin dialami oleh Pemenang Terpilih.

6. Terma Am

a. TNGD tidak akan bertanggungjawab atas sebarang kerugian langsung, tidak langsung, khas atau berbangkit (termasuk tetapi tidak terhad kepada, kehilangan pendapatan, kehilangan keuntungan, atau reputasi yang timbul daripada atau berkaitan dengan Kempen ini).

b. TNGD tidak bertanggungjawab terhadap sebarang isu teknikal, kegagalan, gangguan, atau kejadian lain yang berada di luar kawalannya.

c. TNGD berhak untuk meminda, memadam, atau mengubah Terma dan Syarat Kempen ini atas budi bicara dengan memberi notis lima (5) hari tentang pindaan tersebut dan pengguna hendaklah terikat kepada perubahan tersebut. Notis tersebut akan dipaparkan di laman web TNGD atau platform lain yang mungkin ditentukan oleh TNGD.

d. TNGD berhak untuk mengambil sebarang tindakan terhadap mana-mana pengguna, Peserta Layak dan/atau Pemenang Terpilih yang tidak mematuhi mana-mana Terma dan Syarat di sini, didapati atau disyaki menyalahgunakan dan/atau mengganggu Kempen, mana-mana ciri dalam TNG eWallet, prosesnya, atau operasinya, termasuk tetapi tidak terhad kepada, menjalankan sebarang aktiviti mencurigakan atau penipuan yang melibatkan sebarang tindakan penipuan, tipu daya, dan/atau penipuan.

e. TNGD berhak untuk menahan sebarang manfaat di bawah Kempen dengan pemberitahuan kepada pengguna sekiranya pengguna didapati melanggar terma dan syarat Pengguna TNGD. https://www.touchngo.com.my/assets/pdf/user-tnc.pdf .

f. Keputusan TNGD adalah muktamad. Sebarang surat-menyurat yang berkaitan dengan keputusan yang dibuat oleh TNGD tidak akan dilayan.

g. Terma dan Syarat ini akan ditadbir oleh undang-undang Malaysia dan sebarang pertikaian yang timbul daripada atau berkaitan dengan kempen ini akan dirujuk kepada bidang kuasa eksklusif Mahkamah Malaysia.

7. Privasi

a. Dengan menyertai kempen ini, Peserta Layak bersetuju dan membenarkan data peribadi mereka dikumpul, diproses, dan digunakan oleh TNGD mengikut Polisi Privasi TNGD.
