Terms and Conditions

  1. The Jom Pergi Zoo Campaign (“Campaign”) is open to all Touch ‘n Go Card users residing in Malaysia, existing and new, except for staff of Touch ‘n Go Sdn Bhd (“TNG”) and TNG Digital Sdn Bhd (“TNGD”).
  2. The Campaign will commence on 4th November 2021 and end on 7th November 2021.
  3. The Campaign mechanics are as follows:
    1. Register your TNG Card on TNG Portal (accessible via https://tngportal.touchngo.com.my)– to earn 1x entry per successful card registration
    2. 10x winners will be chosen and each winner will be awarded one pair of Zoo Fit e-Vouchers (2x vouchers per winner)
  4. By registering more TNG Cards, the more entries you will earn and the higher your chances to win a prize.
  5. Entries are automatic and participants may have multiple entries but will be eligible to win only one prize in the Campaign.
  6. The details of the prizes are as below:
    1. 10x pairs of Zoo Fit e-Vouchers issued by Zoo Negara (“e-Vouchers”) to be awarded to 10x winners of the Campaign.
    2. Each e-Voucher includes 1x unit of the following:
      1. Free admission to Zoo Negara for an adult (13 – 59 years old)
      2. T-shirt (Micro-dry fabric)
      3. Finisher’s medal
      4. e-Certificate of adoption featuring Orangutan
      5. Set lunch at The Wild Restaurant
      6. Goody bag
    3. The terms and conditions of the e-Voucher are as follows:
      1. Valid until 31 December 2021. Valid for one day (on the date of visit).
      2. Not exchangeable for cash, nor can it be replaced if lost or stolen.
      3. Not valid with other promotions and discount offers.     
      4. Please present vouchers to Zoo Negara to claim the items set out under Clause 6(c).
      5. Limited to one transaction/ receipt per voucher.
    4. The e-Vouchers will be delivered to the winners via their registered email address with TNG
  7. Winners of the Campaign will be announced on 19 November 2021 on the Campaign’s landing page that is hosted on the TNG website.
  8. Winners are responsible to ensure that their personal particulars, email address, contact details and address are accurately registered with TNG.
  9. TNG shall not be held responsible or liable for any late, misdirected, lost or unsuccessful efforts to notify the winners. Winners are advised to check the winners announcement which will be posted on the TNG Website.
  10. In the event any prize has been forfeited or is unclaimed for a reasonable duration, TNG may, at its sole discretion, give the forfeited prize to another participant from the remaining eligible entries. In such an instance, this other participant (“Replacement Winners”) shall be selected using a method to be determined by TNG at its sole discretion.
  11. Replacement Winners will be announced on the Campaign landing page on the TNG Website. For any Prizes to be forfeited or left unclaimed at this point, there will be no further Replacement Winners.
  12. The prize won is not exchangeable, transferable or negotiable. TNG reserves the right to change the prize at its discretion to another prize of similar or lesser value without any prior notice. All selected winners who have been notified or contacted are deemed final.
  13. Any cardholder who terminates their TNG card, or whose card is terminated during the Campaign period shall be automatically disqualified and shall not be eligible to win the prize.
  14. TNG expressly disclaims any and all liabilities arising from any delays, lost, damage or unsuccessful transmission of the Prize.
  15. TNG reserves the right to request for written proof of residency and of the age of the winners before the prize is dispatched, collected or presented.
  16. By participating in the Campaign, you consent and agree:
    1. To abide and be bound by the terms and conditions of the Campaign including any amendments or variations thereto as well as any decisions made by TNG;
    2. For TNG to collect, record, hold, store, use, and disclose your personal data (defined below) for purposes which are necessary or related to the participation in the Campaign;
    3. For TNG to disclose or publish your personal data such as your names, identities, and any general information that TNG sees fit, on any media, marketing, or advertising materials;
    4. Grant TNG the absolute and unrestricted right to modify, use and publish any still or moving images and written caption of the participants for any promotional, marketing, commercial, or other related purpose, without any payment or compensation; and
    5. To abide by TNG’s Terms and Conditions (please refer to www.touchngo.com.my for details). The participant confirm that all personal information and data (“personal data”) submitted by the participant to TNG are accurate. The participant hereby gives their consent to TNG to process and/or use any of the participant’s personal data and to release the same to TNG’s related and/or affiliated company, TNG’s existing, future business partners and/or strategic alliances and/or any other third party as TNG may in its absolute discretion deem necessary or expedient for the purpose of marketing and promotion of its products and services. Further and in addition thereto, the participant hereby confirms that no further permission nor consent from the participant would be necessary or required in relation thereto and that this shall constitute consent for the processing of the participant’s personal data.   17. TNG reserves the right to reject any entry or disqualify any participant without assigning any reasons whatsoever and reserves the absolute right to cancel, terminate or suspend the Campaign with or without any prior notice and/or assigning any reason. For the avoidance of doubt, cancellation, termination or suspension by TNG shall not entitle you to any claim or compensation against TNG for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
  18. TNG, its subsidiaries, affiliates, associated companies and related corporations (as defined under Section 7 of the Companies Act 2016) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with the Campaign (in which case that liability is limited to the minimum allowable by law).
  19. The terms and conditions contained herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Campaign.
  20. TNG reserves the absolute right to vary, delete or add to any of the terms and conditions of the Campaign in this document (wholly or in part) from time to time without any prior notice to you. TNG’s decision in relation to all aspects of the Campaign is deemed final, binding and conclusive under any circumstances and no correspondence, complaint or appeal whatsoever will be entertained.
  21. These terms and conditions shall be governed by and construed or interpreted in accordance with the laws of Malaysia. Any dispute, controversy, claim or difference arising out of or in connection with these terms and conditions, or the breach, termination or invalidity thereof (“Dispute”) shall be settled, in so far as it is possible, by mutual consultation and consent. Parties hereby submit to the exclusive jurisdiction of the courts of Malaysia in respect of any Dispute.
  22. No failure or delay by TNG in exercising any right, power or privilege under these terms and conditions will operate as a waiver or an estoppel thereof, nor will any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any right, power or privilege hereunder.
  23. If any provision hereunder is held to be illegal, invalid or unenforceable under present or future laws, such provision shall be fully severable and these terms and conditions shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part hereof and the remaining provisions shall remain in full force and effect and shall not be affected by the illegal, invalid or unenforceable provision or by its severance herefrom.
  24. You shall not assign any right under these terms and conditions or transfer its obligations hereunder without the prior written consent of TNG. You hereby consent to TNG assigning or transferring its rights and obligations hereunder without notice to you and you shall do all that is reasonably necessary to give effect to such assignment or transfer.
  25. The terms and conditions which are expressed so or which by their very nature are meant to survive the termination or expiry of the Campaign shall so survive. Without derogation to the foregoing, this Clause 25 and Clauses 16,18, 22, 23 and 24.
